High Court lets stand decision on S.D. Scouts lease (must rent at fair market value)

SAN DIEGO — The U.S. Supreme Court has decided against hearing a dispute over San Diego’s discounted leasing of city parkland to the Boy Scouts.

The decision lets stand a lower court’s ruling to ban such agreements because they give preference to religious groups.

At issue was a 2003 ruling by U.S. District Judge Napoleon Jones in which he struck down leases for 16 acres in Balboa Park and another half-acre on Fiesta Island that the city granted to the Scouts under a no-bid and, initially, nominal yearly fee. The judge said it violated the state’s constitutional ban on government preference for religious groups.

The Scouts have leased land in Balboa Park since 1957 for $1 per year. After the case was filed, the city negotiated a new lease, and the Scouts pay $2,500 in fees per year.

$2500 a year for 16 acres in Balboa Park is way too low. They are still getting a deal. I live just up the street from this area, about 1/2 mile. Beautiful parkland bordering the world renowned San Diego Zoo and a Junior High School. I'm sure if a competitive bid were put out the city could get way more than $2500 a year!

3. zOMG! This is yet ANOTHER attack on religious freedom by teh homofascists!!11!
You know Concerned Women for America, American Family Association, etc. are going to try to use this as further "proof" of religious persecution against Christians in the United States. I'm just trying to beat them to the punch. :hi:

The lower court's ruling was fair and just and it provides preference to no one, which is how public accomodations should be provided. Good on the SCOTUS for not granting cert to its appeal.

6. In order to determine the "fair market value" of the property
they should open the bidding up to more groups than JUST the BSA :) hehehe
