Obama administration to deport gay spouse of AIDS patient
Anthony John Makk of Australia must leave the U.S. by Aug. 25, the deportation order says. Makk married Bradford Wells, an American citizen, seven years ago. they have lived together for 19 years in San Francisco. The U.S. Citizenship and Immigration Services denied Makk’s application for permanent residency on July 26, citing the Defense of Marriage Act.
“I’m married just like any other married person in this country,” Wells said to the San Francisco Chronicle . “At this point, the government can come in and take my husband and deport him. It’s infuriating. It’s upsetting. I have no power, no right to keep my husband in this country. I love this country, I live here, I pay taxes and I have no right to share my home with the person I married.”

Although President Barack Obama and Attorney General Eric Holder have declared that DOMA is unconstitutional and that the Administration would no longer defend it in court, they also said they would continue to enforce the law.

Makk said he has never been in the U.S. illegally.

1. WHY would they continue to enforce a law they deem unconstitutional?
I don't get it.

I'm not thrilled with Holder, but I don't know if it would be different if someone else headed the department. :(

3. This is so disturbing. I hope the various bloggers
who kept writing that 'DOMA is no longer enforced' when they were out to trash Dan Choi read this and issue apologies in public. That goes for a few DU members as well. Those who attempt to deny the impact of this law are culpable in these inhuman actions. They know who they are.

5. As I commented elsewhere, heterosexuals sure do get nice work, don't they?
They get special rights in immigration matters where those who are not heterosexual are discriminated against.

6. If I was a woman
I would offer to marry him in another state. If the Feds still pursued deportation, they would be forced to give Federal recognition to his existing marriage in order to prove that the second was invalid.

to help support these poor guys? I've searched all the names in the article, but haven't found any way to donate to help fund their cause.

I can't wait to hear how this is the fault of the professional left or Congress or something. I'm sure we'll also soon hear about how the President of the US is just powerless or something to that effect.

The professional left doesnt understand that only Congress has authority over the executive branch!
