http://www.365gay.com/Newscon05/12/120605scotus.htmThe Supreme Court was told Tuesday that if universities want federal funding they must allow military recruiters on campus even when the schools disagree with "don't ask, don't tell".
The Bush administration is appealing a lower court ruling that said the Solomon Amendment, a law tying funding to military recruitment drives, was unconstitutional by restricting the schools' freedom of speech.
Solicitor General Paul Clement told the justices that when the U.S. government funds research and education grants, the military is entitled to demand "a fair shot" in terms of equal access for its recruiters to a university's "best and brightest."
actually, by discriminating against gays and lesbians, isn't the military denying itself "a fair shot" at ALL the "best and brightest"
hmm?
