Transsexual jailed for lying about gender, fights for right to marry as woman

From Court TV Online:

She was born a man, became a woman, was betrothed to a man, and then was thrown in jail for it.

Now, instead of paying a $500 fine on charges she lied about her gender, Sandy Gast is waging a legal battle for transsexual rights in Kansas.

...Beginning Monday, a judge in the Leavenworth County Circuit courthouse will try Gast for falsely swearing on a marriage license, which carries a $500 fine...

i hope SHE wins. I hope that she has a good lawyer too.
I'm curious though, how did law enforcement find out that she is a transsexual?

The laws really need to be standardized.

I wonder how much of her legal paperwork had been changed before her marriage. For instance, if her birth certificate has been legally changed to Female, they have no business questioning her gender.

Otherwise, she (and many other TG people) is sort of in a legal limbo where the laws are mostly nonexistent.

I hope she wins it, she shouldn't have to put up with that crap (nor should anyone)

3. This isn't the first time this has happened in Kansas
This has come up at least once before in the state. As the law currently stands, a transsexual can marry a member of their birth sex. It hasn't happened yet, as far as I know, but it'll be interesting when Kansas has its first legally sanctioned same-sex marriage.

That is to say, until Chimp Co. came to power. Now the whole country has gone right wing nutso. This story is just wrong. How can people be so filled with hate and intolerance.

11. This is why transsexuals are silenced
because people use Ann Coulter as a cheap, quick joke about TGs. It never fails, even in a space on the board where transgenders are supposed to be treated with civility, that someone brings Coulter up and pathologizes real TG men and women who quite frankly have enough struggles in our everyday lives.

Backward, hillbilly (my apologies to any freethinking mountain people), archaic, ignorant, hate mongering (need I go on?). She BECAME a woman. The doctors say so, the DMV says so, heck, even Court TV Online says so. So didn't lie on the license. She is a woman. End of argument.

As sexual minorities no matter what we think of each other, we should stand up and work for each other's rights. With the Democrats backing away from supporting our rights, we have only each other and our straight allies to turn to.

8. Hope it's a Legal Technicality
While I hope that Law Enforcement is all screwed up on this one. I get the impression that she never had her sex legally changed. The legal change should be granted without question. But not getting it done is like driving a car with a expired inspection sticker. It's still breaking the law.

Well maybe some will check/verify their legal status as a result of the publicity.

Not all states will change the sex designation on your birth certificate.
