"The state's petition for an entirely open-ended stay of further proceedings is an inappropriate attempt to evade critical oversight of its efforts to bring the employment benefits programs into constitutional compliance," the Alaska ACLU said in an eight-page response filed with the high court.
The state earlier this month asked the court for at least a year to comply with the ruling. The ACLU wants the benefits offered by May 10, a day after this year's legislative session is expected to end. The ACLU says the May deadline is enough time for state lawmakers or administrators to provide benefits.
In the meantime, the ACLU wants current benefits to be extended to employees and their partners who joined it in appealing a lower court's ruling that led to the Supreme Court's October decision.
