Federal Court Rejects Appeal From Matthew Shepard Killer

A federal judge has refused to grant a review to the case of Russell Henderson, one of two men convicted in the slaying of Matthew Shepard.

U.S. District Judge Clarence Brimmer rejected Henderson's motion for a writ of habeas corpus. A state district court and the Wyoming Supreme Court previously rejected Henderson's motion.

Attorney, Tim Newcomb, argued that Henderson (pictured) was never told he could appeal the two consecutive life sentences he received under a plea agreement.

Newcomb argued that by not informing Henderson of his right to appeal he was effectively denied his right to appellate counsel.

2. Matthew Shepard's father
changed his mind about asking for the DP - the only reason that guy is still even alive at all.

Personally I think we should make assisted suicide available to lifers at any time they've had enough.

That would be humane and save us shitloads of give-a-damn.

I wish he could get a taste of his own medicine - barb-wire tie HIM to a fence post in the freezing cold after getting beaten - put a cyanide capsule in his hand for when it "gets too much" Fuck him - I have no sympathy for him

but then we wouldn't really be any better than what we despise.

It sure would feel good though. But we wouldn't be any different ourselves.

I can't imagine that given the relative rarity of this kind of provision that the judge wouldn't have asked about this.

7. Uuummm, no. This is merely an appellate attorney doing
his/her job. It's the attorney's job to sift through the entire case and attempt this or that appeal argument(s). This didn't fly. Nothing stuck to the wall. Nothing else to it. The choice now is whether it will be further appealed. Again, it's what appellate lawyers do. What's the defendant got to lose?

RIP, Matthew Shepard.
