Prop 8, why can't a counterproposal be presented by California Democrats?
I was unable to find an online link of the study, but I remember back after Bush stole the 2000 election there was a university published study on elections, and part of the reading of it that stuck out with me was that when it comes to yes/no proposition proposals there was a very significant percentage of people who tend to vote "yes" down the board on proposals like that.

With Prop 8 looking like it's going to be a tough fight as it is, I'm concerned that the auto "yes" people could very well be the difference between equal rights and discrimination being written into constitutional law.

My question is, could it be possible for the Democrat legislature to put up a counter proposal for a constitutional amendment that allows for marriage between any 2 consenting adults?

It would give us a hell of a lot of leverage for a legal battle should prop 8 actually pass, if the counter proposal also passes.

2. At this point, it's far too late to qualify initiatives for the next ballot
It would have to be in a future election, and (if 8 passes) the strength of precedent would be on the side of what's already in the constitution. Far better to reject this now.

Personally, I suspect that there are far more automatic no people in CA these days than automatic yeses...

3. How about an amendment
that says that no discrimination will be allowed in any public facility?

What would happen if one part of the constitution says one thing and another part directly contradicts it? Which part wins?

4. its too late to do anything on the ballot
If democrats in the california government want to help, they will speak out against Prop 8.

BTW, Jerry Brown did help california (and his action was challenged by republicans) by wording the proposal in a very special way:

ELIMINATES RIGHT OF SAME–SEX COUPLES TO MARRY.

By voting yes, people see they are ELIMINATING RIGHTS not "PROTECTING MARRIAGE"

Every little bit helps.
