Judge Walton issued a today regarding Fitzgerald’s prior motion on procedural issues surrounding CIPA and classified documents review.

To make a long legal wrangle short — Team Libby did not want Fitz to be able to send classified documents for ex parte review to the judge, they wanted Fitz to have to haggle every document out adversarily with regard to discovery issues. Fitz wanted everyone to follow the procedures as required by CIPA, which allows for such ex parte submissions where there is a question about the danger of national security by the dissemination of the information contained therein.

Fitz won.

But in a way, I think it's designed to be confusing.

After all, the first charge in this fiasco was for obstruction of justice -"throwing sand in the umpire's face", as Fitz put it.

Throw Luskin into the mix with his misleading statements and leaks designed to muddy the waters even further...

I've long given up trying to keep up with the who said what to whom and why it's relevant.

That's why I'm glad Christy and Jane are on the case. Kristy, especially. She's a lawyer and knows all the ins and outs of complex law cases and can cut through the crap like no one else.

11. Great news!
Scooter is an attorney. He has to know that doors are being closed behind him. He is being moved in the direction that Mr. Fitzgerald had said he would, when he refused to take a deal because it included significant jail time.
