BREAKING: FITZ IS IN DC AND GRAND JURY IS SCHEDULED TO MEET

ABC News' Jason Ryan reports, "The grand jury hearing the leak investigation case is scheduled to meet at 9:30 am ET. Special prosecutor Fitzgerald is in town for a 1:30 pm ET hearing before Judge Walton in the Libby case. The hearing will be a status conference requested by Libby's lawyers after Fitzgerald disclosed in court papers that President Bush had authorized Libby to disclose sections of the National Intelligence Estimate on Iraq's WMD."

24. The Grand Jury is not meeting on the Libby case, the indictments
have already been handed down in that case from all I understand. The current Grand Jury is looking at other evidence, etc, that Fitzgerald has/is presenting in the continuation of the investigation into the leaking of a covert CIA agent which, given Rove having appeared recently, certainly includes him in the mix, imo.

Whether any indictments will be handed down today, who knows. Fitzgerald is under no artificial time line to produce for public gratification. One has only to look at his previous cases to see he seeks indictments when his investigation on the target is complete.

A quick review: there are, in fact, two types of grand juries. The first, which is the most common, hears a prosecutor present the basic outline of a case, then either returns an indictment or does not. These meet regularly, but are not the type in this situation.

The second type is an investigatory grand jury. They are case-specific. Note that the Libby grand jury did not hear drunk driving or burglarly cases in between the Plame hearings. Mr. Fitzgerald convened a second investigatory grand jury on 12-7-05, and that is the one meeting today. It should not be confused with a grand jury that might be hearing other cases. It absolutely, positively is not.

The confusion comes from media reports between the October indictments of Libby, and the new grand jury, when it was noted Mr. Fitzgerald could present information to a "type #1" grand jury for an indictment. That is not what this is. It is, without any question, an investigatory grand jury. And today, it is meeting for one purpose only: the Plame scandal.

How do you know what type of grand jury that's meeting this morning, and that it's about Rove? There could be others? Q: Is it too late to reindict Libby, if new info has been revealed?

The MSM, as usual, is failing to cover this adequately. That's a crime in itself.

69. The media is made
up primarily of people who are not well versed in what is happening. There are a few who I think are worthy of recognition for knowing about what is going on. One would be MSNBC's David Shuster.

On my posts here, I try as a general rule to make clear what I know versus when I am speculating. For example, I am going to say that those of us who watch David will recall that exactly one week after Mr. Fitzgerald set up the new grand jury, David was a guest on the Tucker Carlson show. There, he said that Mr. Fitzgerald had set up the new grand jury to address issues that involved Karl Rove. David said on that night that he was under the impression that Mr. Rove was going to be indicted, sooner or later, by that grand jury.

I think that in the next couple of days, people will speculate on what is going on. This will take place on DU and other sites. I think it is interesting to watch how various people channel the excitement. Some will be prone to doubt. Others will find it an opportune time to attack some journalists. Others, like you, will approach it from a positive position, assembling the most important facts for a foundation to base your opinion. We have an interesting group, and I'd like to take the opportunity to say that I always enjoy discussing this case with you.

We are going to have a lot of fun this month.

89. First grand jury was not a special grand jury. Which is why it expired

when it did and could not be further extended. It had already been extended up to the max of a regular Fed grand jury. I recall looking it up at the time. A special grand jury could have been further extended.

As I recall this grand jury is not a special grand jury either. Fitz did not convene a special grand jury but rather is using a regular grand jury that was already sitting in the District.

I read that as two separate appearances by Fitzgerald, assuming Fitzgerald is meeting with the Grand Jury and they are not meeting alone which, if so is very interesting in itself, imo. We know Fitzgerald is meeting with Judge Walton regarding Libby but that doesn't negate the GJ meeting for a separate reason, imo.

The GJ meets every Wednesday and Friday. It may be used by any prosecutor for any case. It is not a Special Grand Jury. Just because they meet does not mean Fitz will be using them today. I would think that PF would be very busy this morning. He has a BIG hearing this afternoon.

cases at the same time ala Plame case, Illinois corruption case, Conrad Black case, so it seems reasonable to assume he could appear at both the GJ this morning and the hearing this afternoon with little difficulty, imo.

I read however, that this hearing was announced (I think) just Tuesday night. I think that only gives Fitzgerald 2 days to cram for it. Christy Hardin Smith talked about that at FDL. You could be very right. Everyone is just guessing. That is the fun and exciting part.

They could be hearing something to do with Rove, or they could be meeting to hear something completely unrelated - they serve D.C., not just Fitz.

Hopefully it's Rove, but I trust in Fitz that he will do things methodically and at the right time. Regardless, It will be an interesting day.

There are two distinct things going on today. In the morning, the grand jury investigating Mr. Rove meets to discuss his future.

In the afternoon, Mr. Fitzgerald meets with Judge Walton and Team Libby to discuss Mr. Libby's future.

There are many things that are cause for happiness, if not mild excitement.

Whether it's about Rove or Plame or not. All that is known for sure is that they are meeting - firedoglake wrote about this the other day, that they have other cases to consider as well.

Not withstanding Leopold's miss again, and the third time he's stated a month old Target Letter as FACT, I'm holding out for major news coverage from many sources, not one with a curious set of sources.

Every Wednesday The Note publishes that Fitzgerald’s grand jury is scheduled to meet in Washington DC at 9:30 that day and everyone jumps on it like my dogs on bacon.

This morning:

The grand jury investigating the CIA leak may meet this morning at the federal courthouse in Washington, DC.

It means that the room is scheduled in case there is any need to call them. As it is every Wednesday. As Christy has noted many times, this is a regular grand jury, not a special grand jury and even if they do meet it may not have to do with the CIA leak investigation — any federal prosecutors in the DC Circuit can use them.

Yet every week, people link to this like it’s some big break in the case. Well one day they might be proven right, one day it just MAY turn out to be the day that they indict someone. Which puts a whole lot of hoopla in play over something that may turn out to be nothing more than a stopped clock that is sure to be right twice a day.

(BTW Christy’s superb analysis of the latest Libby filing was heavily excerpted in Editor & Publisher today, and deservedly so.)

That's the link I was looking for, it's almost 6 am where I am been up all night and groggy, couldn't find it, but had read it and it was superb..

appreciate you posting this, for all those that want to know the true workings... BTW, the folks at firedoglake are actual LEGALS, at least one is a Prosecutor, maybe Christy, not sure, and THESE are the people in the know.. esp since Fitz is TOTALLY tight lipped..

wouldn't surprise me if Fitz wouldn't put ANYONE who leaked from his office in the Clink as well.

I believe that Leopold was Speculating a great deal on a radio show that's been paraphrased on the DU since.. Target letter received a MONTH ago, Thursday announcement of Friday, "Rove to be Indicted.." same old same old..

If I were him I'd be breaking some thumbs about now as his sources seem to be leading his astray more regularly than usual.

And with everyone hoping and praying that Rove Gets what he desearves, the emotions are running quite high here on the DU, lots of arguements, people saying that long time DU'rs are GOP agents just waiting, like five years, just so they could bust everyone's fun license on Rove..

Silly stuff like that.

Hearing Today in Libby Case

There is a 1:30 pm ET status conference scheduled in the Libby case today. ABC’s Jason Ryan reports that it was scheduled at the request of Team Libby:

ABC News’ Jason Ryan reports, "The grand jury hearing the leak investigation case is scheduled to meet at 9:30 am ET. Special prosecutor Fitzgerald is in town for a 1:30 pm ET hearing before Judge Walton in the Libby case. The hearing will be a status conference requested by Libby’s lawyers after Fitzgerald disclosed in court papers that President Bush had authorized Libby to disclose sections of the National Intelligence Estimate on Iraq’s WMD."

Two things: first, I want to reiterate what Jane said about The Note’s reporting on the grand jury scheduling in this case. This is a regular grand jury — the grand jury room is booked every single Wednesday and Friday for them, in case any US Attorney in the DC Circuit needs to use them for indictment or other grand jury purposes. This jury isn’t reserved solely for Pat Fitzgerald’s use. And as far as I know today, he isn’t meeting with them (he’s got a hearing to prep for this afternoon, after all). Trust me when I say that if we have news that Fitz is meeting with the Grand Jury, we will definitely share it with you guys.

Second, a status conference can be a number of things, but is generally a review of a particular issue that has come up or an evidentiary matter or some other targeted reason for discussion among the adversarial parties and the judge to receive some form of clarification. As I recall, this is actually a hearing on whether or not the information that Libby disseminated "classified" (or secretly declassified, depending on your source of info) information on order of the President from the NIE will be used at trial and, if so, how it will be used. (Have had some difficulty getting my hands on the motion and scheduling order for this, so I’ll amend as I get that in hand this morning if need be, but I’m fairly certain that is today’s argument topic.) Normally, this sort of 404(b) evidence isn’t argued until much closer to trial — but my hunch is that Judge Walton wanted some clarification on this as well, given that he’ll be having to make CIPA classified information determinations after this week’s ruling.

More news on this as I get it.

is not on the calendar as of noon EST. There is speculation that the prosecution may have asked for a continuance given the short notice. The hearing was ordered on Wednesday.
