'Your argument makes no sense' Judge tells Bush lawyers. 'It's ridiculous'
Judges challenge Internet wiretap rules

WASHINGTON - A U.S. appeals panel sharply challenged the Bush administration Friday over new rules making it easier for police and the FBI to wiretap Internet phone calls. A judge said the government’s courtroom arguments were “gobbledygook.

The skepticism expressed so openly toward the administration’s case encouraged civil liberties and education groups that argued that the U.S. is improperly applying telephone-era rules to a new generation of Internet services.

“Your argument makes no sense,” U.S. Circuit Judge Harry T. Edwards told the lawyer for the Federal Communications Commission, Jacob Lewis. “When you go back to the office, have a big chuckle. I’m not missing this. This is ridiculous. Counsel!”

31. Definition of Activist Judges
Those judges who, in their supreme arrogance, think their job is to uphold those antiquated, obsolete, misguided "laws" instead of doing what they are supposed to be doing, and that is supporting the new, incredibly prescient, perceptive and all-around brilliant ideology espoused by their Supreme Commander in Chief, President and Ultimate Leader, George (Blessed By God) W. (Wise Above All) Bush (Better Than The Best). They are also as annoying beyond tolerance as they are naive beyond belief of the coming New Order (on Earth, as it is in Heaven). Not to worry, they will be eliminated along with all the other non-believing infidels infesting the great nation of the United States of NOB (the New Order of Bush).

All Hail the NeoCons (New Controllers), Masters (wannabee) of the World.

Interesting Historical Note: They considered, but in the end rejected the acroym NeoComs (meaning New Commodians) because, it seems that it's apparent implied association with controlling "toilets" as well as sounding like "commedians" was just not quite in keeping with their desire to inspire awe--regardless of how realistically accurate it may have been in terms of definition (few people appreciate just how much power and humor the comedic controllers of commodes/toilets would wield, especially if beer has been served to their audience).

David Shuster reported that Libby had been warned in 'o3 by the CIA that she was undercover and not to reveal her name and status. Also, reported that FitzG. was very reticent regarding KKK which Shuster took as a sign that an indictment is on the way.

...The Justice Department, which has lobbied aggressively on the subject, warned in court papers that failure to expand the wiretap requirements to the fast-growing Internet phone industry “could effectively provide a surveillance safe haven for criminals and terrorists who make use of new communications services.”

Critics said the new FCC rules are too broad and inconsistent with the intent of Congress when it passed the 1994 surveillance law, which excluded categories of companies described as information services.

The FCC asserted that providers of high-speed Internet services should be covered under the 1994 law because their voice-transmission services can be considered separately from information services. “Congress intended to cover services (in the 1994 law) that were functionally equivalent” to traditional telephones, Lewis said during the hearing in U.S. Circuit Court for the District of Columbia.

Geezus, another Clarence Thomas!!! You want to talk about "activist judges"...these "morans" don't even bother with the arguments, they make up their mind to stay with the party line before they hear an argument.

Clarence Thomas is a disgrace to the bench. He is far too stupid to ask a question. He is disrespectful to the bench. He has put his feet up and eaten during arguments at the US Supreme Court. Some have often wondered if he was sleeping.

Looks like we have another Thomas in Rogers Brown. Another disgrace to the bench!

No, wait. It's whatever we want whenever we want it. When we want to give massive giveaways to big corporations, it's an information service. When we want to spy on everybody everywhere, it's a communication service.

For anyone who doesn't know what I'm talking about: The FCC classified the net as an information service rather than a communication service for the purpose of allowing big cable companies to charge for sending information down their pipes. But now when they want to wiretap the net, suddenly it's really a communication service.
