Dear Gov. Dean -- “Finally, it has started.”

With those words, former Congresswoman Elizabeth Holtzman commences a cogent assessment of why George W. Bush must be impeached. Her article will appear in the January 30, 2006, edition of The Nation and was published online Wed. evening, 11 January, 2006. It is entitled “The Impeachment of George W. Bush.”

As you know, Ms. Holtzman was a member of the House Judiciary Committee during the impeachment of Richard M. Nixon. Her perspective on the nature of the situation is stated clearly in her last two paragraphs:

If a Republican Congress is unwilling to investigate and take appropriate action against a Republican President, then a Democratic Congress should replace it.

As awful as Watergate was, after the vote on impeachment and the resignation of President Nixon, the nation felt a huge sense of relief. Impeachment is a tortuous process, but now that President Bush has thrown down the gauntlet and virtually dared Congress to stop him from violating the law, nothing less is necessary to protect our constitutional system and preserve our democracy.

Yes, in as brazen a stunt as telling Iraqi’s to “bring it on” (and they have), Mr. Bush, on December 18, 2005, declared that he indeed had been breaking the law of the land and he intended to continue spying on American citizens without FISA oversight and approval.

Repeatedly, Mr. Bush has lied about Iraqi WMD and has persistently linked 9/11 to Saddam Hussein.

Ms. Holtzman summarizes the situation as follows:

Like many others, I have been deeply troubled by Bush's breathtaking scorn for our international treaty obligations under the United Nations Charter and the Geneva Conventions. I have also been disturbed by the torture scandals and the violations of US criminal laws at the highest levels of our government they may entail, something I have written about in these pages (see Holtzman, "Torture and Accountability," July 18/25, 2005, http://www.thenation.com/doc/20050718/holtzman). These concerns have been compounded by growing evidence that the President deliberately misled the country into the war in Iraq. But it wasn't until the most recent revelations that President Bush directed the wiretapping of hundreds, possibly thousands, of Americans, in violation of the Foreign Intelligence Surveillance Act (FISA) -- and argued that, as Commander in Chief, he had the right in the interests of national security to override our country's laws -- that I felt the same sinking feeling in my stomach as I did during Watergate.

As a matter of constitutional law, these and other misdeeds constitute grounds for the impeachment of President Bush. A President, any President, who maintains that he is above the law -- and repeatedly violates the law -- thereby commits high crimes and misdemeanors, the constitutional standard for impeachment and removal from office. A high crime or misdemeanor is an archaic term that means a serious abuse of power, whether or not it is also a crime that endangers our constitutional system of government.

For the sake of America, I think it important that every Democratic candidate for Congress should state unambiguously that they will hold Mr. Bush and members of his administration accountable in the 110th US Congress, if the Republican controlled 109th US Congress does not do its job.

Simply, Gov. Dean, impeachment is no longer a partisan issue, it is the only way both Democrats and Republicans in the 109th US Congress can honor their oath of office, and avoid being collaborators in Bush's ongoing high crimes against Americans and others.

No more important issue confronts America than holding Bush and his administration accountable for their lawlessness and their avowed intention to continue being outlaws.

7. I understand your frustration, but it'll certainly never happen
if we just give up.

The coming months are going to be devastating to BushCo. People who have no idea what's actually going down in this country will be treated to at least some of the awful truth via the MSM. It'll be impossible to ignore.

I think that I'm much older than most of you here at DU, and have seen a lot of things in my 73 years on this earth. There have been times when it seemed unthinkable that someone in a high position of any kind would ever be brought down; but, it happens. For instance, the executive vice-president of a long running bank where I worked, was a tyrant but seemingly untouchable. Guess what, I left the bank for another job, and when I walked in the first day, there this once big man sat at a small desk in a crowded room, typing his fingers off and looking stressed out; Yes, he had lost his big paying position, and was reduced to a "lowly" job by his standards. Everyone gets paid back sometime down the road, and you can count on it.
At least, we can hope Bush is brought down to his size which is very very small........Just look what has happened to DeLay and Abramoff, etc. :nopity:

NOTHING has happened to DeLay as yet. AND what about "Kenny Boy?" I'm NOT that young, I worked for McGovern... a hippie if you will!

I've NEVER seen America in such bad shape. I TRULY TRULY hope you are CORRECT! I really really do! But as each scandal rears it's ugly head, and there have been more than enough to bring down at least 2 or 3 Presidents... this JERK just SMIRKS his way through!

But let's remember... Impeachment MUST take them BOTH! Smirk AND Snarl!!! Think of the alternatives if we get stuck with SNARL!!!!

Just got back to this thread and was just wondering. I for one don't happen to think there will be an Impeachment. Sure would be nice, but I'm not trying to be a "wet blanket!"

Johnathan Alter and Franken said that they are wanting to wait until after the Dems return to power. But this issue would've been pounced on ravenously by Newt Gingrich's fanatics and not met with reason and waiting.
I'm sick of DINO's wanting to show deference to these thugs and criminals.

The country has set the bar so low for the performance of George W. Bush as president that it is effectively on the ground.

No one expects very much from Mr. Bush. He's currently breaking the law by spying on Americans in America without getting warrants, but for a lot of people that's just George being George. Forget the complexities of the Foreign Intelligence Surveillance Act, or even the Fourth Amendment's safeguards against unwarranted (pun intended) government intrusion into matters that we have a right to keep private.

On his frequent trips home to his ranch in Texas, the president likes to ride his bicycle. He's not studying the Constitution.

If Members of Congress are paying attention they should quickly be realizing that they have two, and only two choices:

Hold Bush and his neoconster minions accountable before the law;

That should read "Impeachment SHOULD no longer be a partisan issue". Unfortunately, with Bush's party in power, and being the most corrupt group of theives we've ever had in Congress, it IS a partisan issue.

With Nixon we had the Watergate tapes as evidence, without which he may not have been brought down. With Bush we have him admitting on national TV, not only that he broke the law and undermined our constitution, but that he would continue to do so. With a Congress with any integrity that should be enough to get him impeached.

God help us if our election system isn't reasonably fraud proof by 2006.

I agree. I also agree with the "should" modifier.

What I'm suggesting is that we must force the members of the 109th to make a decision - uphold the law and their oath of office, or not. Each R should be given the opportunity to demonstrate that they know that breaking the law is not consistent with their party's agenda.

We need to do that before November 7, 2006, so it is clear to everyone exactly who selected to be accessory to Bush's crimes, and who attempted to bring Bush and his neoconster minions to justice.

Yes, that's the next big one. This president has a series of scandals, any one of two of which (depending on the death toll) would have him out of office if there were any mobilizing force nation wide. What's a mobilizing force? Information providers are one force, you know the CM. If they would cover any of the major scandals for more than three or four days, cover them like a real story, public outrage would have this guy out. But they don't. Another mobilizing force is a national organization, i.e., the Democratic Party, which could force more awareness, although there are limits because the party is partisan. A third force, a bit random, might be an unusual alliance of high profile figures with little or nothing to gain.

It's all good however. Try as they have, the axis of unconstitutional behavior and general chaotic and destructive behavior has failed to invoke a dictatorship. The public sentiment is consistently negative now, 38% in Pew for *. With no opposition party and no press coverage, the American people are doing a great job of awareness. The 38% is not bedrock, it can go lower, like to 22-25% (those people who think Nixon was innocent and Dreyfuss was guilty).

In fact, when one observes Bush's disapproval rating (as merely one parameter) it suggests the formidable spin, that you correctly document, is not working.

Part of the reason is that more and more of our fellow citizens are participating in the 'blogosphere' and part of the reason is that many of our fellow citizens have excellent bullshit and corruption detectors.

The biggie is that they don't dig anyone spying on them and being told by spymaster-in-chief that he's gonna continue spying, and breaking the law to do so, will likely be viewed by historians as a second "bring it on" moment for Bush -- and that he got what he asked for, both times.

Stay the course; uptick the intensity of the messaging.

Your insight inspired the way I organized my response to Jane's description of what we are confronting, more and more successfully, each day.

I remember the very moment I heard of the existence of the "tapes" - nearly wrecked my car driving from Bethesda back to our home in G-town) - and, even knowing that those tapes existed I still wasn't sure that Nixon would be forced out because I was concerned that no one would ever hear what was on the tapes.

We now have a President who admitted breaking the law and stated he intended to continue. We don't need to worry about getting access to the tapes - we've got a self-confessed and unrepentant criminal acting like a teenager playing "chicken."

32. Is anything going on behind the scenes?
I'm so frustrated and full of despair. I'm desperate to hear some news that some democratic senators are seriously discussing impeachment. This is a start, I suppose, but The Nation doesn't seem like a big enough forum to make that much of a difference. The republicans seem to have a perfect formula for taking over the country, big money from the religious right and big money from corporate America. I can't stand what is going on in this country!!

Last Saturday, I went to a town hall meeting on the Iraq War and impeachment in Madison, Wisconsin. This one was sponsored by Veterans for Peace. More than 150 other events around the country on January 7 were co-sponsored by Progressive Democrats of America and afterdowningstreet.org.
