Immigration/Permanent Residence Question: Please help
I'm married to a Japanese national and she has a green card and we've been in the US for about 10 years s she is in the process of renewing her green card...

She heard on NPR today something that disturbed me and made me realize how little I know about our country's policies now that Immigration and Natiralization is now Homeland Security.
What she heard was that there are 3 ways in which you become eligible for permanent residence -and here's the thing- being married to a US citizen was NOT one of them. I always assumed it was - I mean we got a green card 10 years ago!? Anyway the 3 were roughly: 1) If you have special skills that are in demand 2) If you have a direct family member apply (slow!) 3) Political Asylum

So what is the deal? I am becoming afraid my wife could lose her permanent residence status and am afraid to ask the "authorities".

If you know anything, please help me out and no, my wife doesn't want to be a US citizen and I ceratily aren't encouraging her.

1. You're OK
If your wife has her green card -- assuming she hasn't committed any crimes that qualify as "aggravated felonies" under the Immigration and Nationality Act -- she ought to be able to renew her green card without any problems (other than horrendous USCIS inefficiency).

2. She WILL NOT lose status
If she came here on a I-130 or I-129f marriage based visa she has already passed the 2 year conditional status.

If she was H1B and has already succesfully been granted Permenent Residence status, the conditions of H1B no longer apply.

Basicly as long as she has not committed any felonies she will be fine. But really if she plans on staying should she be appling for citizenship? She has already fullfilled the requirements of living here for 3 years.

If you need more information on her immigration status try this site
