DOJ Moves to Dismiss AT&T Class Action under Cover of Night
Early Saturday morning, in the darkest hours of the night, the Department of Justice made good its threat to file a motion to dismiss our class-action lawsuit against AT&T, contending that AT&T's collaboration with the NSA's massive and illegal program to wiretap and data-mine Americans' communications (which violates the law and the privacy of its customers)--despite being front page news throughout the United States and the subject of government press conferences and Congressional hearings--is a state secret. The motion was accompanied by declarations by Lieutenant General Keith B. Alexander, Director, National Security Agency and John D. Negroponte, Director of National Intelligence. We will vigorously oppose this motion. Donate to EFF and help stop the illegal spying!

5. EFF helped rescue our Verified Paper Ballot Bill here in NC for us!
They did it "gratus" and without them we couldn't have gotten our bill through the NC Legislature and gotten Diebold to turn tail and run from NC.

I gave what I could afford to them for that. If you have only Five Bucks send it to them...They do good stuff!

... like Monday morning if possible. Already dumped them for the most part yesterday ...

I was told that the manager was rushing around all over the place in a "state of absolute panic". Yeah, panic dude, panic. That is because EVERYONE that can and has a brain will dump AT&T in every way they can (in my case no more long distance crap plan for $2.00 and to hell w/the call waiting that I was paying for).

SCREW YOU AT&T.

MBNA is history as of today also ... L. L. Bean free shipping ... sorry can't take them either anymore (MBNA, not LL Bean which has basically outsourced most of their products sadly). :(

The US govt is getting involved in a private matter. Violation of contracts, and customer's rights is none of their business. I'm beginning to think there is No low that they won't stoop to.

12. There is a law--
I think it's Federal rule 403--that says evidence must be admitted if the probative value outweighs the prejudicial effect.

There could not be a more classic case for the judge to apply it here. There is no "imminent" danger to national security merely by disclosing the existence or extent of this program.

That is the standard the government would have to prove under the State Secrets Act. It's not like revealing the beach landing locations of a Marine assault tomorrow.

The judge should find the prejudicial value is not only outweighed, but he would very likely be sanctioning covering up illegal acts.

17. Didn't the DOJ also dismiss
their own investigation of the NSA spying because they couldn't get security clearances? If the DOJ doesn't have security clearances to know what the program is, how are they able to file motions on the NSA's behalf?
