It's not clear whether Bush etal thought it was water under the bridge they didn't have to worry about, or if there was some sort of agreement on the timeline. Either way, he knew a year before the Congress and the rest of American knew. And he knew he was thumbing his nose at Congress while stomping on the Constitution.
