AMERICAblog just bought General Wesley Clark's cell phone records for $89.95

I reported the other day that your cell phone records are on sale online for anyone to buy, without your permission. Well, this morning AMERICAblog bought former presidential candidate, and former Supreme Allied Commander of NATO (SACEUR), General Wesley Clark's cell phone records for one hundred calls made over three days in November 2005, no questions asked. (Clark's cell phone provider is Omnipoint Communications, which seems to be related to T-Mobile.)

All we needed was General Clark's cell phone number and our credit card, and 24 hours later we had one hundred calls the general made on his cell phone in November. The calls included a number of calls to Arkansas, to foreign countries, and at least one call to a prominent reporter at the Washington Post. To ensure that we actually had General Clark's correct cell phone number, we called the number this morning and the voice mail recording that answered said:

"Hi, this is Wes Clark, leave a message ."

We have subsequently called that number and spoken to a real person to confirm its authenticity, and to make sure General Clark was aware of this issue and what we were doing.

This is clearly outrageous. But let me first say, as an aside, that I bought my own Cingular Wireless phone records this past weekend and reported on it on AMERICAblog. I wouldn't do this to any other public person without first doing it to myself. But even after reporting on this gross violation of my (and your) personal privacy, Congress, the Administration, and the phone companies have yet to act effectively. (And they have known about it since at least this past July when the Washington Post reported on it.) So we decided to attempt to buy the records of a celebrity, so to speak. And we unfortunately succeeded.

3. Omnipoint hasn't existed in over 4 years.
T-Mobile bought the company and integrated them. There is no Omnipoint anymore. Just like there is no AT&T Wireless anymore.

...I think is so outrageous about this is that it cost $89. The airwaves are a public commons. INformation regarding their use by ANYONE should be freely accessible. THe communications themselves are privileged, and protected by law, but the fact that you used the public airways to place a communication is NOT private. There is no conceptual difference between calling someone on a cell phone and shouting at them across a crowded room.

So, tell me why our government and our privacy groups have known forever about this problem (the Washington Post wrote an article about this last July), yet no one has done anything to fix it? Oh sure, Schumer "introduced legislation" to fix it and is waiting. Gee thanks Chuck. At least you got your face in front of a camera. This is the kind of story that gets legislation passed in a day, it's so outrageous. Either you don't care or you're incompetent if you introduce legislation on something this outrageous and you have sit back and wait for it to be considered. But hey, at least Schumer tried, so to speak - where were the other Senators and House members? Where is our president?

Now, before you write this off as just another sad story, let me explain to you just how serious the situation really is - not just to your own personal privacy, but to law enforcement, every politician in DC and around the country, and to national security.

1. Are you an FBI agent with confidential sources?

Again, I quote the Sun-Times:

To test the service, the FBI paid Locatecell.com $160 to buy the records for an agent's cell phone and received the list within three hours, the police bulletin said.

2. Are you a police officer with confidential sources?

The Chicago Sun-Times paid $110 to Locatecell.com to purchase a one-month record of calls for this reporter's company cell phone. It was as simple as e-mailing the telephone number to the service along with a credit card number. The request was made Friday after the service was closed for the New Year's holiday.
