Will * get to fill a third SCOTUS vacancy?
Roberts and Alito will not be replacing a liberal judge, so it isn't really, really bad yet. But Stevens is 85 and Ginsburg has had cancer. Off hand, I don't know the health conditions of the others.

Ginsburg can probably hang in there, but Stevens at 85 is downright iffy.

What is the health of the others?

What do you think the chances are of * getting still another seat to fill?

1. I think it's better than 50-50 that the Chimp gets another one.
Stevens will try to hold on, but that will be tough.

But it's going to get harder and harder to get his Borklings and Scalitos in there.

9. I was agreeing with your cite of Ginsburg and Stevens . . .
Edited on Fri Jan-13-06 12:18 PM by MrModerate
Although Ginsburg would probably prefer to die than let Schimpanski fill her seat; Stevens may have no choice in the matter.

8. Very possible
after all the real liberal judge on the court, Justice Stevens is 85--while he is in good health, we can't expect him to wait forever for a Democratic president.

10. The nation had better hope not...this would be seriously scary
I hope that Justice Stevens and Justice Ginsburg can stay until 2009...because the next vacancy...that's going to be the vacancy that gives the Dominionist freaks their wet dream vote.

11. No chance
Stevens has been interviewing for intern positions for the next 2 court sessions (years) so it does not seem he will leave. Ginsburg seems to be healthy enough to last a few more years. But the next president will probably choose at least 2 and maybe 3 in the first term alone.

12. probably slightly greater than 50% chance for one
It really is a crap shoot because people's health can be so unpredictable. I could see him getting zero, one, or two more shots at filling a seat.

If it gets too far into the 2008 presidential campaign then would be quite a fight to delay filling the seat until the new President was seated.

14. I wouldn't be shocked
And as much as some here hated her, O'Connor was certainly a swing vote...and more or less saved abortion rights in Casey. Aliton is almost certainly going to change the nature of the court.

after the election because she didn't want chimpy filling her seat. But she couldn't wait another 4 years due to her husband's health.

18. O"Conner has publicly stated that she would wait for a Rep admin
to retire. The only reason she did not retire during *'s first term is because of the hell that would be raised as a result of * v Gore.

20. Could 2008 be any more important

It is possible that we will lose two Liberal judges...TWO....

TWO....If a George Allen or someone wins in 2008, then the Court will most likely become 7-2 Conservanut. 7-2....we think 5-4 is the abyss....7-2 is something I cant fathom.

we have to start making headway this year...2006 elections the Democrats need to start developing some momeuntum. We can't allow the Repukes to shoot themselves in the foot...We must get our shit in gear.

7-2 is the end of the world as we know it (and I dont feel fine)

28. Sadly I think * will probably have to fill another SCOTUS vacancy
if not 2 more. I've heard rumors on TV about Stevens retiring at the end of this year's term, I've also heard rumors of a possible Kennedy or Souter retirement. I don't know, but I tell you that if * gets to appoint another nominee, especially one of the liberal/moderate judges, we are going to be royally screwed, not like that really matters now.

31. You have to keep in mind the fact that if Alito does get on the
court, the court will already have moved to the right. The fact that Stevens or whoever they were talking about this morning will now be considered the "swing vote" is simply a way to measure our continued loss. The court will become another tool of the far right. I wouldn't look for much true justice to handed down if that happens.
