Freepers complain and gripe about no-knock search ruling
Edited on Thu Jun-15-06 03:59 PM by Charlie Brown
I just found all this tragically amusing since it was "their" judges who called this one.

http://www.freerepublic.com/focus/f-news/1650013/posts

"So if cops perform a no knock raid (and don't identify themselves verbally on their way in) on the wrong house and the homeowner defends himself thinking his life is in danger and in the process kill one or two of them but survives himself would he be forced to stand trial?"

"That's really sweet coming from Mr. Scalia. Don't worry, you can go to liberal lawyers and after three years of lawsuits you might get some money. Maybe. Sounds like he's rubbing it in our faces."

"A lot of people, on both sides of the badge, are probably going to die as a result of this."

"Scalia hates the 4th Amendment with a passion and would strike the whole thing down if he could, and would even cite foreign law to do it."

http://www.freerepublic.com/focus/f-news/1649860/posts

"If the police don't announce themselves, they leave themselves with no legal protection against righfully being shot and killed by the residents of the abode as they break and enter. The residents would be able to successfully argue self defense against unknown intruders, with reasonable justification to assume that the unknown, unannounced entrants had harmful intent."

"This decision is not conservative...a true conservative on the bench would protect individual rights and the rights of the people to be safe and secure in their homes. No knock home invasions are extremely dangerous for both the police and the homeowner...and when mistakes are made as they often are, innocent people die.

Alito and the others are traitors to we the people and our constitutionally guaranteed protections."

expanded eminent domain earlier this year. I disagreed with those judges then, and I disagree with these judges now. Both of the decisions go against the rights of the average citizen, ruling instead in favor of business and the encroaching police state.

To: Steve_Seattle
I just realized that in my last post you might have thought I was referring to crooks as citizens with jobs. That's not the case. I'm saying that hurdles for the police in their admittedly valuable work, should never be used as an excuse to weaken BOR protections for suspects, because the occasional honest citizen will inevitably fall into the same situation. Nobody held a gun to their head and forced them to go through the police academy. We, the citizens, their superiors. shouldn't be expected to give up Constitutional protections just because those protections make the cops' job harder. The BOR was there when they decided to become cops. A free society is what they're SUPPOSED to be trying to defend, not an occupational hazard.

Oh now government works for the people. Funny they didn't think that yesterday.

I love how when someone mentioned that their guns vs police they all went nuts. See rights do matter.

The police wouldn't (spy on you / search you / torture you) unless they had good reason, right?

And what's with this fear of guns?

Guns don't kill people. People kill people. And only bad people kill good people.

After all, my gun has killed one less person that Laura Bush's car.

The erosion of the rights of the accused. The 4th Ammendment really took a big hit with those guys and looks like the new court is taking up where Rehnquist left off.

Sad to say that no one will ever win an election campaigning on the rights of the accused. Won't happen.

Or maybe they have 12-clip magazines with a Class B permit, when their state law says they can only have a 9-clip magazine without a Class A Permit?

Those little technicalities can get you in trouble.

Not to mention whatever Junior may have downloaded for his iPod.

Or perhaps Daddy (Or Junior?) accidentally downloaded kiddy porn while legitimately searching for regular pictures of vanilla sexual acts? Or by opening the wrong email?

Maybe they "borrowed" some Viagra or some Ambien from a friend, and keep a few of the pills in the night stand?

Maybe they have some "home-made fireworks" in the basement?

Maybe they bought something from a vendor on the sidewalk that "just fell off the truck?"

Maybe they have pirated movie DVDs?

Or maybe those "wrong-numbers" from foreign-sounding people that keep calling are really Al Quaeda operatives, and now their phone number is listed as part of a "terrorist network" and being monitored.

Someone might buy a pre-paid Tracfone, program it with the phone numbers of Republican donors, and just use it to call them and say things like, "It is too hot to have the wedding."

when they supported The Patriot Act. Then they supported Gen. Hayden, who doesn't even KNOW the 4th Amendment, despite his oath to defend and protect the Constitution.

They supported Domestic Spying!! What Amendment did they think was violated when the whole nation was put under surveillance?

And why do we even bother fighting for THEIR rights, when they are too partisan to realize what they are supporting?

They better all go join the ACLU ~ the only hope left of stopping this Fascism, or at least slowing it down ~

It's fun to watch them whine about losing their rights now, but it's infuriating to think of all the arguments I and others had with freepers over the Patriot Act!

51. The only cop who comes this way is a friend, the dad of a neighbor
i love him to death.

I doubt he would break down my door. But suppose some other county or state cop tried that around here? Every neighbor is packing heat, and every neighbor would assume that the person breaking through the door was a meth-head doing a home invasion.

I, for one, when confronted with a person bashing in my door, would, by reflex, shoot in that direction. I am not ending up outlined in police tape on the floor if I can help it. Some cranker beat a guy to death with a clawhammer near here recently. Sure. I'll be more than happy to let someone breaking down my door identify himself first before firing. NOT!!!!!

Now, I have the utmost respect for cops. there are a lot of good ones here in Tennessee. But I'm not going to think it's a cop when my door falls in. Sorry. That's reality. The Supremes may have gotten hard-ons thinking how they are turning back centuries of common law JUST CUZ WE CAN ! LA-DEE-DAH!!!!!!! but they are setting officers up for sure death in many places.

I look for the right to bear arms to fall in the toilet as well. freepers will go ballistic, but this is exactly what they paid for- Fascists, not Americans. Poor little stupid freeps. Didn't know what they had til it was gone.....and their Repuke buddies took it all away.....boohoo.
