3. he's on probation if I'm not mistaken....
So this should be a probation violation. On the other hand, my money's on a slap on the wrist and a walk. And in the end, that's an appropriate response to drug possession, IMO.

18. Just required treatment. Illegal possession would be a relapse.
They could bring back the original charges if a VOP charge stuck. they didn't punish him for the first offense--Why would they now?

Nothing happens here either.

5. I think you have to have served time to be put on parole.
So it's probably more than probation. Which he broke if he was carrying perscription drugs that weren't perscribed to him. Maybe Karl Rove will regret not being indicted, after all.

6. We need someone with knowledge of prescription laws.......
.......and/or doctor's prescribing laws/ethics.

Is it EVER ok for a doctor to give a patient a prescription made out to the doctor/ For privacy reasons(per the article)? Could the courts/probation office have OK'd such an arraignment?

This sounds TOO good to be true. I'm going to wait before I celebrate.

10. well it's like this
he and the good doc were (playing golf at the club OR vacationing at the same place) and Rush just happened to notice that the doc had left his prescriptions laying around - so like the good samaritan he is, Rush picked up the presc and put them in his bag fully intending to return them to the doctor. Move along. No story here.

But my understanding is that for a drug to be legally dispensed, the prescriber must provide the name of the person the drug is prescribed to on the rx or when they call it in. If they allowed doctors to "hide" who they were prescribing medications to in that manner, there would be a huge black market of doctors backdating charts to get drug users in possession of pharmaceuticals not dispensed in the patients name off the hook.

for 98% of people, this would mean being incarcerated immediately and hit automatically with the full possible penalty for the crime he was charged with *prior* to his deal that gave him probation.

He is a privileged member of the ownership caste though, so who knows. He'll probably continue to get away with it. The rich are never brought to the same justice as the rest of us.

First he did agree to the terms of a plea deal connected to his last set of charges...And he gets a new case before he was due to be sentenced on the plea deal....
Tough call I am thinking he may be looking at sometime on this one,,,

14. I thought adjudication
Adjudicated charges are removed from one's records after a period of time if there are no further violations. One pays the fine for the offense, but the charges are removed.

15. He had 18 months
in which we was not allowed to break any laws.

That ruling was back in April. He's a little short.
