Bush sunk by Navy lawyer following orders

Lt. Cmdr. Charles Swift

It was a naval officer - ironically working for Osama Bin Laden's former driver - who torpedoed President Bush's plans to put terror suspects on trial before military tribunals.

Lt. Cmdr. Charles Swift, appointed by the military to be lead counsel for Salim Ahmed Hamdan, said he was just following the President's orders when he scored a landmark victory against the White House.

"The President gave me a job to do in his military order that I was to provide a zealous defense," said Swift, 44, a graduate of the U.S. Naval Academy in Annapolis, Md. "I've just done my best to live up to it."

A month after taking on Hamdan, Swift filed a stunning brief that compared Bush's tribunals to those of King George III on the eve of the American Revolution.

honor. Bush doesn't.

So, I don't see the irony. After all, it was Colin Powell and other military types who argued the practices at the Gitmo facility.

They knew what was going on wasn't in the letter or spirit of the law.

24. I saw him on Washington Journal the morning before...
he went before the Supreme Court. This guy is awesome, really really good. Comes across as a regular guy, real blue collar Joe Average, not at all puffed up or arrogant. But super smart, thinks on his feet, with a real grasp of the law and the history of America. I was VERY impressed. I'm not surprised he won, he was on with the lawyer for * for this case, and *'s guy was totally outmatched. It was obvoius Swift was the better lawyer; and his case was solid.

30. Actually, this ruling doesn't provide much hope...
It was essentially a 5-4 decision. Roberts probably would have entered in if Kennedy were on board. The entire matter hung upon the whims of one man - Anthony Kennedy.

Our Constitution is in shreds. One tattered piece of it lives on temporarily due to the decision of one ruling class elitist, who just happened to have a lucid moment... this is little cause for celebration. I look for the cabal to accomplish the same evil ends in a way that the corporatist lackeys on the court will eagerly endorse.

Furthermore, I expect no enduring good to come from the Anthony Kennedys of the world. Such men do little more than put some occasional lipstick on a pig so the masses can pretend to live in a democracy a little longer. At their very core such men could care less about the ideals upon which this country was based. They exist to serve the ruling class.

We live in a country with a Supreme Court that is not committed to a Constitution upon which our entire way of life is grounded. They occasionally get it right, but they are more likely to get it wrong because they serve another agenda.

31. Maybe this is more than a dark lining
in a silver cloud. One vote separates us from a crony court, not simply tossing a close election to their main guy but granting total dictatorial powers to the presidency. Given the craven nature of Congress any opposition from that gutted quarter would be as easily dismissed as anything else and no barrier at all to ordering armed forces or police against any REAL opposition.

One vote away from total dictatorship which Bush is already flaunting. If not this case then others may be presented to open that door now that the Godking has been irked and denied his easy will. And he damn well is not waiting on the subservient favors of legitimacy winding through a groveling, sweating GOP Congress. Like Napoleon in his final stages of hubris, he prefers to seize the crown from the captive Pope.

One vote from the highest court tossing the entire law into the befouled Potomac.
