Apartments won't let friend called to active duty out of lease
Amazing, a friend of mine who has been called up was told by his apartment's manager that he will own them $4,500 for breaking his lease. There is a clause that allows a the lease to be broken with no penalty if a tenant is called up for active military duty. According to my friend the manager looked at him and said something to the effect "That means the 'Merican military not the Jew military."

I have a feeling the apartments are going to lose, I've seen the Texas Apartment Association lease that everyone uses and it only says active military duty, nothing about it having to be a specific country's military.

1. I the "Jew" comment is legitimate, the landlord already lost.
Slam dunk. Period. He doesn't have a leg to stand on.

3. Federal Soldiers' and Sailors' Relief Act
protects against creditors' abuses against soldiers and sailors -- but I think it only applies to service in the American military.

Anybody else know?

4. Call the ACLU
If this landlord is stupid enough to have said that, get them on his arse for being a bigot. And I'd also call your local Rep. The local TV stations, newspapers, etc.

Shine a light on that bigot!

5. He left the issue with his attorney

the apartments don't have much to stand on, it's just unbelievable they could think it only applies to the American military.

6. Conversely
Active military means that he could be fighting in ANY military.
They left themselves wide open on that.
OTOH, in case you--or he--wasn't aware, the military gives soldiers access to attorneys to get their affairs in order before they are deployed.
He needs to utilize this service to take care of this matter.

7. Is your friend going into the Israeli IDF?
Tell him to call his Congressman and complain about this "Hezbollah loving" landlord.

That should get some action.

8. Just a point of clarification here
Since the words "Jew military" were used, am I to assume that it's the Israeli army that called him up? And also, is he an Israeli citizen, a US citizen, or both?

I thought that military service was mandatory in Israel, so I'm wondering how he got "called up" in the first place, if that's the case. Not defending the redneck landlord at all, and I agree that he'll probably lose the case, but wouldn't your friend have had some idea that Israel would be looking for him?

9. Israel has compulsory active and reserve service.
Every Jewish, Circassian and Druze man and woman over 18 is required to serve on active duty for three years; thereafter they become reservists who can be called up at any time up to their mid-40s.

Because Israeli reserve call-ups are compulsory, dual citizens are generally not in danger of losing their American citizenship.

In the case of this person, deep in the heart of redneckland, I think playing the Hezbollah card is all one needs to do to make that landlord wish he could join the IDF.

Obviously it means the US military. Tell him to meet his financial obligations and then he can go kills Lebanese children with a clear conscious.

12. How is it obvious?
Does it specify the US military?

And I'm sure there are a host of men that were at one time conscripted to fight in a conflict they disagreed with right here at DU who would take offense to your ridiculous characterization of them.
