Today we enjoyed a big victory in the courts.
Judge Anna Taylor Diggs ruled today that the NSA's warrantless wiretapping program is unconstitutional. This ruling is another blow for a President seeking to erode our constitution. This is another step toward restoring the checks and balances that are the foundation of our system of government and central to the constitution.
The administration has done its best to minimize the impact of this decision, but I submit to you that it is a very significant ruling. In a very well-reasoned ruling, Judge Diggs explained the NSA warrantless wiretapping program "violates the separation of powers doctrine, the Administrative Procedures Act, the First and Fourth amendments to the United States Constitution, the FISA and Title III." She further clarified that "the president of the United States ... has undisputedly violated the Fourth
in failing to procure judicial orders."
This should come as no surprise. Conservative legal experts have joined those throughout the political spectrum to denounce this program as unconstitutional.
I respect and fully support the need for U.S. law enforcement to conduct wiretaps to protect our country from terror threats. What Judge Diggs has ruled, and what I fully support, is that these wiretaps must occur within our legal system. No one person is above the law. Even the President.
