Has anybody alleged that Foley committed a crime?
Or is he just a hypocrit? It looks like a lot of people on both sides are dancing around with fancy words, but I can't find anything that even looks definitive.

According to the GOP, he has done nothing wrong and is not a pedophile. Yet, he's resigned, admitted to alcoholism, being gay and sexual molestation by a priest.

I don't get it.

8. I believe they're investigating whether those communications
meant he was using the internet to solicit sex from a minor. That would be a crime, and from what I heard, the law making it so was championed by Foley himself.

11. It's under investigation.
Possible charges include:

Contributing to the deliquency of a minor
Crossing state lines to contribute to the deliquency of a minor (hence the FBIs involvement)
Any number of internet predation crimes he signed into legislation
furnishing alcohol to a minor

Not to mention the things we don't know about yet, but are still quite possible: child pornography, statuatory rape, child molestation, etc.

13. He absolutely has broken the law...NO QUESTION.
You cannot proposition a child or someone you think is a child for sex, simulated sex or to initiate a meeting likely to result in sex. The IM's today that were released talk about he and an underage boy meeting for food, drink and whatever. He also talks about getting a child to masturbate in terms that a judge would consider sexual.

He is going to be charged. Likely, under laws he helped write and he exploited to gain reelection. He may not serve any time. If he were a civilian with normal rights, he would have to register as a sex offender for the rest of his life. I suspect he gets less in exchange that he not tell anything about what he had to give the Repubes to keep his secret quiet.

15. The age of consent is only relevant if the sexual partner is
of similar age or within a certain age range. It does not legalize sex between a 52yo and a 16yo minor.

Emails even allude to it.

Even if the age of consent was 16 in DC, the law Foley helped draft sets the federal standard for electronic communication at 18. The pages were under 18 at the time of the communication in question.

17. You are confused about what age of consent is
The age of consent just means that person can have sex with someone not more than XXX years older than them. A minor is someone under 18, regardless of anything else. Let's say the AOC in a state is 15, and an adult can't have sex with anyone more than three years younger than them. In this state, they can have sex with a 15 year old, but not a 14 year old, not could they of they were 19. However, NO ONE can have sex with someone under 15, regardless of whether the person having sex with that person is 15, 16, 17, etc... because the other person is under the age of consent AND a minor.

19. Age of consent is 18 in Florida
So I would guess if he was IN Florida when he solicited a minor, he's guilty of a crime. Federal law appears to be 16 for most sexual crimes, although some are 17 and 18. It just all depends on which jurisdiction applies to which crimes. But they sure are spinning the notion that no crime has been committed, and we really don't know that yet.

It is pure bullshit that sex had to actually take place for there to be a crime. The people who are saying that are pure idiots.
