Foley, who checked into an alcohol rehabilitation facility in Florida, also "reiterates unequivocally that he has never had sexual contact with a minor," Roth said.

But instant messages obtained by ABC News do reveal that Congressman Foley met with an underage page in San Diego, a meeting which they spoke about in an instant message exchange from April, 2003.

1. Minor = individual under 16 years of age

The pages were over 16, so they weren't minors.

So maybe he was doing them left and right.

Edit: His LAWYER said a minor. And his LAWYER also said, no "inappropriate" sexual contact with minors. (There's appropriate sexual contact?) At any rate, even if Foley would call people under 18, "minors" when chatting on America's Most Wanted, what's to say his lawyer wasn't using the definition under state law, totally getting out of the way of the laws Foley himself sponsored for federal standards?

3. Semantics - where I live
16 is the age of consent, but you are still a minor until you are 18. Heck, you even have a "junior drivers license" until you are 21 here. When did a minor become someone who had reached the age of 16? Where does that apply? Even felony charges aren't brought on anyone under 18 unless they stipulate that they are charging and trying them as an adult.

So, when did 16 become the new 18?

13. My point is a lawyer said it, hence it is semantics.
Reading "no inappropriate sexual contact with a minor" as saying he didn't have sexual contact with pages (who are all 16+) is simply wrong, wrong, wrong, and falling for a lawyer's word games.

If they did it in California then I'm pretty sure the age is still 18. It was when I lived there.

23. It's 18 in California
It looks like any federal laws that might have applied were overturned by the Supreme Court. The only one that looks like it might be federal:

"It is forbidden to knowingly persuade, induce, entice, or coerce any individual to travel in interstate or foreign commerce to engage in prostitution or any criminal sexual activity."

If it's illegal for an 16 year old to consent, I would assume this law would apply.

Of course, Foley doing something with consenting peers of his own age is one thing. Preying upon teenaged boys is another. I suspect this is all coming out because one of these boys got tired of his bullshit.

I didn't see anything that applied to online only, unless any pictures were sent and boys under 18 sent them. That could qualify as online pornography I suppose.
