The Rs announced that they would spend $40MM this election in negative ads aimed at the "dirt" they had on Dems. That might have worked pre-Foley, but the worm has now turned and their chances are non existent to hold the House. They are close to losing the Senate. $100MM in negative ads wouldn't work at this point.
This is too much of an uphill battle for them to fight and win in 4 weeks. So their only real chance is to challenge the vote itself after the election. They will blame it on e-voting, stating that the Ds have been in the forefront on criticizing e-voting as unreliable. They will also say that post-Foley, Americans deserve to know that their Congress critters were elected fairly and without prejudice or machine malfunction. They will frame the issue as their "protecting the voting rights of all Americans, no matter what their political stripe."
They have the money to pay for challenges and recounts across the country, but they will concentrate on the closest races. They will need to turn only 1-3 Senate races and maybe 10 House races to their favor to keep control of Congress.
Ultimately, they can keep control of both houses simply by keeping the elections up in the air and uncertified through the day that Congress reconvenes in 2007...at which point, Denny Hastert can seat anyone he wants in the House (citing his recent actions in the House as precedent) and declare that the House recognizes them as the legitimate winner. He may even seat a few Ds to make it look bipartisan while, of course, keeping an R majority in the House.
Rs have a very good record on "winning" elections in the courts (or otherwise) and they have no morals, so it's a road that they are more than willing to travel.
