Who cares if your loved one is missing at 1:30 A.M.?
I tried calling people.I wanted to figure out if the police stopping a family member who was coming home from work and stopped and arrested after passing a breath test in the field. Officer wrote a ticket for erratic driving. Another for OWI. In the office two more breath tests showed no alcohol. After booking for three hours and no rights read, no phone privileges, and total cooperation. Some questions ranged from military status to the fact that his tongue looked green and indicated use of pot. Can't tell you how amazed I was to hear that once in squad car. His personal vehicle was searched. Some of my neighbors told me to call the chief. I did. The chief said that my family member had no rights. The police did nothing wrong, and the lack of phone call home was to protect my sleep.

1. The Chief is a f**king liar.
Unless, of course, he is following the GWBush version of the Constitution. I would make a phone call to the mayor's office.

Sounds like the goon squad called the locals and told them to do some arresting and questioning. I guess they told the locals that American citizens have no rights anymore. I hope said person is okay and safe at home?

4. Why no rights?
Surely if person is a minor then parent/guardian would be notified, sleep or not...
and very often, if loved one ISN'T home at 1:30, waking somebody up isn't going to be an issue!

5. A lot of conservatives I know honestly and truly believe
that a criminal, by breaking the law, has forfeited all of their human and civil rights, and is no longer a human being.

They also believe that all suspects are criminals (potentially) and should be treated as such.

Honest to God, I know at least 10 people who believe this.

Its a sick world

7. Before you raise hell.
It might depend on the state, but on average, just so you know.

Reading someone their rights usually doesn't matter if they aren't going to ask any questions. Since they have the tests, statements wouldn't matter much. Usually the right to remain silent only matters if they plan to use statements in court. Most people are stupid enough to give up that right anyway.

They can usually search the car after an arrest.

Often, the phone call is within a reasonable period of time. Probably no violation there.

Passing the tests though, that's a different story! And tongue looked green? No one's tongue turns green by smoking pot.

If you can, talk to a lawyer, and maybe one here will correct me some.

8. My ex-partner got picked up...
..once for DUI and once for soliciting a prostitute (who turned out to be an undercover cop).
That boy had more dumb luck, I'll tell ya (and those are just two of the reasons he's 'ex') but BOTH times, he was allowed to call me and let me know what had happened and where he was.

He had the grace not to expect me to come and bail his ass out, I will say that for him.
