can anyone answer this?
The top nazis were tried because they had conspired to start a war of aggression and had also committed crimes against humanity. Why cant the same be done here by the tribunal in the hague? it wouldnt carry any weight of course but think of the slap in the face of the arrogant bastards in the white house.

1. We have actually had that conversation on DU....
I think that what the * cabal has done constitutes "War Crimes" and "Crimes against Humanity" 600,000 Iraqi's killed I think the Hague would be fitting for this criminal bunch...

I also think they should be tried and prosecuted in America for "Treason"

That's my 2 cents..

3. The Nazis were prosecuted because they lost
Many of their crimes went unpunished because Churchill, Stalin, FDR, and Truman had committed the same crimes. We couldn't say carpetbombing, for instance, was a crime because Churchill ordered it in Dresden and FDR ordered in Tokyo. However, we didn't start a war or commit genocide, so those were defined as crimes. There was no precedent for trying anyone for such crimes. We just made up the charges after the fact. This is the only possible legitimate use of ex post facto law. There is not precedent for charging anyone with lying in order to promote war, but if we were to follow the Nuremburg example we could legitimately charge administration officials with this.

As far as charging them in the ICC, we could quite easily do such, if the ICC has the will. I beleive that this is our best chance for bringing justice upon the Bush administration. We don't have a history of such prosecutions in our country. However, in my experience the ICC is rather fair. They charged war criminals on all sides of the Kosovo conflict, even though our government claimed the Kosovars were the victims while the Serbs were the only criminals involved.

proud moment for me :

BUSH ON TRIAL

WORLD TRIBUNAL ON IRAQ REPRESENTATIVES DELIVER LAW SUMMON TO BUSH

Tuesday May 17, 2005, Brussels – Today, representatives of the World Tribunal on Iraq (WTI) delivered a law summon and invitation letter addressed to President Bush at the US Embassy in Brussels. The WTI representatives invited George Bush to the final hearing of the World Tribunal on Iraq that will take place in Istanbul between 23-27 of June 2005. It is part of a global action day, as similar actions took place in Lisbon, Amsterdam, Stockholm, Istanbul, Tokyo and New York.

<SNIP>

In front of the US Embassy today, Prof. Lieven De Cauter, initiator of the BRussells Tribunal, and spokesperson for the WTI in Belgium, said: “Since the US administration does not recognize the International Criminal Court (ICC), the citizens of the world have undertaken an initiative to reclaim justice. The world is calling for Bush to be held accountable for the crimes committed in Iraq.”

The World Tribunal on Iraq (WTI) is a worldwide undertaking to reclaim justice. It aims to record the severe wrongs, crimes and violations that were committed in the process leading up to the aggression against Iraq, during the war and throughout the ensuing occupation, that continue to be widespread to this day. The project consists of commissions of inquiry and sessions held around the world investigating various issues related to the war on Iraq, such as the legality of the war, the role of the United Nations, war crimes and the role of the media as well as the social, political, environmental and cultural devastation.

<SNIP>

“We ask Mr. Bush to present his case in front of the jury of concience in Istanbul. We are fully aware that this is a symbolical action but we firmly believe that international law should be respected and that war crimes should not be met by indemnity” concluded Mr. De Cauter.
