I think Bush is going to capitulate on the minimum wage bill
It's not like most of Bush's veto threats have ever materialized into an actual veto, save for once (the stem cell bill). Rather ironic for a man who claims to be such a tough talking Texan.

And we should open the door for him to do that, for it will only further anger the Gilded Age wing of the Republican Party, who is already pissed off at him for runaway government spending. Sure, we'll be giving him a legislative victory (no thanks to him at all), but this is too important for American workers, so it must be rushed to the top of the agenda.

1. Doesn't Matter. He'll Have A Signing Statement
"Beacause a' the war on terr, the minimum wage is abolished because ah find it necessary-like to beat murca's enemies. They hate our freedom."

8. Signing statements only work when Congress and the courts pretend that they do...
They don't have any legal force, so now that the Rs don't control Congress and have a much diminished chance of stacking the courts, any Administration appointee who decides to obey one of those previous statements that contradict the letter of the bill will have a pretty good chance of finding himself out of a job and tossed in prison. I expect we'll see noticeably fewer/vaguer signing statements from Bush in the next two years...

10. It's A Little More Complicated
Signing statements are simply a cover for Bush to order the Executive apparatus to do anything he wants. There's really no way to stop the signing statements other than possibly impeachment or possibly cutting off funds.

11. Bush can order the executive branch to do whatever he wants,
but if the courts find that the executive branch willfully ignored the clear intent of the law, then the executive branch member responsible is basically hung out to dry, right? My guess is that executive branch employees are going to pretty quickly realize that signing statements are nothing more than paper, and Bush will scale them back to avoid embarrassment...

12. Ah - But Who Will Enforce The Court's Findings?
Bush has argued that the Courts also have no jurisdiction over him. And Bush controls the army. It gets complicated and ugly quick.

I suspect that if Bush had the political capital, he would call out the Army in the ensuing constitutional crisis. However, Bush won't/can't do this now - he'll lose in a showdown, he's got no credibility with the Generals.

(Perversely, I'm almost glad that Iraq happened - it was such a fuck up that it may have prevented Bush's absolute takeover of the US.)

3. Making minimum wage a priority is a good signal of return to populist values by Democrats.
It is a good foundation to get working class white workers in the South etc. back into the fold.

If shrub vetoes, then it can be an albatross around the neck of the 2008 Republican nominee, and congress/Senate candidates.

5. While i agree...
with your logic, I would start from the other end of the equation. The minimum wage boost is too vital to too many people to be held hostage to mere tactical machinations, and must be at the top of the agenda. When you look at it that way, all the other lovely gymnastics -- true though they may be -- become moot.

6. Oh, yes, and...
State minimum wage increases not only passed in Arizona. They passed in EVERY state in which they were on the ballot. Every one. More than the accursed same-sex marriage bans. More than eminent domain limits.
