I'm not worried about Judge Scalito's attitudes on executive power.
Why, I'm sure that as soon as there is a Democratic president, he will "rediscover" the importance of limitations on executive power. His conversion could come as soon as 2009.

4. What worries me is how he'll view challenges to HAVA
After all, since shiny new electronic voting machines were clearly a response to the expressed will of the people who were so, SO embarrassed by those pesky Florida paper ballots, there's simply no question but that those who would question the motivations of Diebold, et. al., are just disgruntled conspiracy theorists with no standing to speak of to bring their grievances to federal court.
