Something I've been wondering with Fitzgerald's case
In GD Politics there is a thread about a letter from Fitzgerald and it shows he isn't showing his cards and there is a good chance either Cheney and/or Bush could be in trouble with the law. What would happen if Bush is indicted by Fitzgerald? (Remember he has visited with Bush's lawyer for the case) Could he be put in jail and the maximum crime or would he not since he's currently pResident?

1. Remember Traficant
Remember Representative Traficant, he was still a member of Congress when his trial started. Once he was found guilty he was expelled.

I'm sure that the same rules would apply to a sitting president as well.

2. Pretty sure sitting Pres can't be indicted, can only be impeached

so the court of public opinion becomes critical there.

Cheney on the other hand can be impeached, indicted or both.

Actually Fitz put a wealth of info in that little 6 page reply, I just posted something else in one of these and there were several other things discussed in the other thread:

3. He can be impeached first, then indicted.
I expect if there is solid enough evidence against Bush he will be named as an unindicted co-conspirator as Nixon was. That would provide the final tipping towards impeachment, and once he was successfully impeached, convicted and removed from office he would be indicted. This is what would have happened to Nixon but for the pardon.

I also expect if this happens, there won't be a pardon by the new pres "for the good of the country" whoever he or she happens to be -- that's a one-way ticket to Gerald Ford City.
