If Wellington Dies, Are We Talking Manslaughter I or II
Any lawyers in the house?

Some sarcasm

Word is that Cheney has lawyers on the ground getting Wellington to willingly sign a willy-nilly statement stating the Wild Will shot himself, and Cheney was taking the blame to cover for Willy's incompetency!

2. Man Two, I believe
Manslaughter one (voluntary) is when you kill someone in the act of trying to injure him. Manslaughter two (involuntary) is recklessly or negligently engaging in behavior that you know or should have known could result in death.

4. Not everyone involved in hunting accidents is automatically charged with
man 2.

I suspect it is extremely, extremely unlikely that Cheney would be charged with anything more than a citation offense, regardless of Whittington's (who the fuck is wellington??) condition.

6. Negligent Homicide would be far more likely
To prove Man II the prosecutor would have to show that Cheney should have reasonably known that his actions were going to harm or kill someone, and that he did them anyway. Cheney's defense would merely have to prove that the VP thought his actions were "safe", and the charge wouldn't stick.

Proving negligent homicide is far easier, since you only have to prove that the killers inattention caused the death. The penalty is lower, but a conviction is more assured.

Of course, keep in mind that charges might not be filed at all. Most hunting related shootings do NOT end up in court unless the DA has reasonable evidence that the person was being very reckless, had been drinking, or had testimony from other hunters that put the shooters actions into question. Legally you are NOT responsible if someone walks into your line of fire during an authorized hunt, so a DA would need to be able to prove that this isn't what happened.
