Crap. Does this mean the SCOTUS isn'tt going to look at Bush's habeus corpus issue?

The issue of holding American citizens without charges for years as enemy combatants NEEDS TO COME BEFORE THE COURT. D

Does anyone know?

It means that the Supreme Court will at present time not decide whether the President can detain an american citizen for three years without charges.

4. If Padilla is in the regular court system....
Doesn't that mean that all the Constitutional protections automatically kick in? It's been my understanding that the sole reason why Padilla was not getting habeas corpus, speedy trial, access to counsel et al. was becasue protections were (somehow) more vague and undefined for military prisoners. Now that he is a criminal prisoner, don't they automatically apply?

5. But the reason the Bush administration, as I understand it, WANTED
him in criminal court, and tried, hastily, to get him transferred a couple of weeks ago, was to avoid the challenge of Padilla's imprisonment without habeus corpus as an enemy combatent, ie, challenging Bush's authority to do that to a citizen.

he's not even being charged on what originally he was stuck in prison on, but other. So, basically, if we took this as a model for our justice system, any citizen could be thrown into prison without charges, and then, other, unrelated charges brought up just to keep them in jail. That's just WRONG.

6. Another question...
If any intel was gained on Padilla through the use of FISA warrants, that intel will not be admissible in a criminal court. How will they come at him?

7. I think he's being charged on a NEW set of charges that have nothing
to do with what he was originally imprisoned for, because they KNEW they can't do that.

10. Only for the duration of and for the purpose of the criminal trial- win or
lose, he goes back as an enemy combatant to continued military detention after the trial.
