The rights protected in the Constitution are HUMAN rights, as the founders intended. They apply to everyone. And exactly why do you hate America, so much? Why are you saying our rights are not for everyone, only people you think they should be? Are you so afraid of a fair, public trial? Who else would you deny these rights too? G.a.y men who caught performing a lewd act in public? American criminals?

The 4th, 5th, 6th, 7th, and 8th Amendments apply to anyone in the country. Terrorist, illegal alien, whatever. They will apply to President Weak and Stupid when he is brought up on impeachment charges for violating the 4th amendment, obstruction of justice and treason in the CIA case.

Sorry, Freeptard. . .until a Fetus is legally recognized as a person (as it is in the third trimester), you have zero idea of what you're talking about. I got my Bachelor's Degree in this topic and will be working on a PhD in Political Science (after I finish my Masters of Educational Leadership). . .but I guess I'm just an over-educated liberal elitist, right?

I believe Abraham Lincoln, our greatest president who freed the slaves and preserved our Union, said it best when he suspended the Writ of Habeus Corpus; "The Constitution is NOT a suicide pact."

The rights would apply because they are human rights, not American rights. Denying human rights would completely validate every Arab attitude about us.

You want to blow the Arab attutide of the Great Satan out of the water to win "hearts and minds." I lost in family in the Twin Towers attacks. I've lost friends in Iraq. I am handicapped and cannot go.

I can't deny the attitude that people are "endowed by their creator" with certain rights, which can be nullified when deemed dangerous. Quote Lincoln. . .the Constitution is absolute. Lincoln was wrong, this now is wrong.

We used to work there.

The theory of government we used to develop our country is directly from Leviathan and the Social Contract. Our bill of rights apply to everyone.

A murderer wants to kill you too. . .An American with a weapon with murder in his/her heart wants to kill you too. . .do the rights apply? Did they apply to Timothy McVeigh or Eric Rudolph or the Unabomber?

They apply to everyone as basic human rights, as dictated by the writings of the founding fathers and the basic political philosophies that were used to found this country.

To pick and choose who those basic human rights go to is unAmerican. Why do you hate American values?

This is from the Declaration of Independence not the Constitution which is our law. The Declaration is NOT LAW!

Last time. . .our Constitution, through the writings and letters of the founding fathers, as well as the political theory that is the basis of our system of government, states that our freedoms are basic human rights. By virtue of being human, all people are entitled to these rights.

Aid our enemies? Are you calling me a traitor because I am constitutional scholar who is more versed in this than you? The Declaration of Independence was the basis for our rebellion. The Constitution was a our end result, mostly by the same men who wrote the constitution. Federalist Papers dictate what I am saying about basic human rights is true.

If this is something you disagree with, tread very lightly. J.ews weren't considered citizens and were enemies of the state under Nazi Germany, as such they were executed.

Problem is, you have one nugget of knowledge and you pass it off as if you are well versed and learned. You're not.

You have proven you hate America and Americans by stating the Founding Fathers were wrong and our rights, that the founders intended to be for all people by virtue of being people, are subjective to political whim. You hate American freedoms, American values and the founders of the American Way of life. You hate my country with a passion and will subvert the intentions of the founders, the Constitution and the Bill of Rights for your narrow political beliefs. You hate America. This is sad, because America has so much to offer.

You advocate what FDR did to the Japanese in WW2. It was wrong then, it is wrong now.

I give comfort to our enemies? Why, because I want them tried in public before to the death they deserve? Because I want the government to follow the document they are sworn to uphold, not use it as toilet paper? Because I believe that everyone is entitled to a fair trial before a first class hanging?

A fair, impartial trial is an American value. If you don't like it, you hate our country. Representation is an American value. If you don't like it, you hate our country.

If you want totality, I can give you at least 50 countries you can move to. I want these people tried in public, following every legal avenue possible, as a showcase of the righteousness of the American Legal system. What better what to do that then to make sure that these people get the full force of American justice with the rights we believe, and the founders believed were basic human rights. Execute the terrorist upon public conviction. It will delay it about six months to a year. You want your blood lust. I want it too. . .but I want it constitutionally. You want it unilaterally. As such, you hate America. What you want is a mockery of justice and of freedom!

That's the point!

And, since you hate America so much that you hate our freedoms and our founders, I am done talking to you. You are on ignore because Freepers like you aren't worthy of intellectual discussions. You're only worthy of scorn, venom and bile. You are dismissed.

And isn't there a constitutional amendment which, when taken out of context, declares corporations as near-humans?

The Bill of Rights extends to every person within US territory, citizen or otherwise. If a German tourist comes here and robs a liquor store, that person has the same rights under the law as anyone else. Otherwise, the government could just snatch that person up and do whatever it wanted to him or her, courts be damned. That is simply not the way it works. Think of all the legal aliens in this country. Can their homes be searched without warrants? No. Can they be held without trial? No. Can they be forced to incriminate themselves? No. Do they have the same rights to speech and assembly as American citizens? Yes. The only thing they cannot do is vote, and that is a provision that is covered in the Constitution proper rather than in the Amendments (modified of course by Amendments on suffrage, etc.). The loopy notion that the rights protected by the Bill of Rights refers only to American citizens is simply dazzling in its stupidity. It's simply incorrect on its face.

And, in any case, they'd have to explain the treatment of Jose Padilla, and American citizen who has been held in utter violation of habeas corpus for the past three years - evfen if one were to accept their manifestly false premise.
