may be the 'canary in the coal mine' on how the Obama Administration is going to apply the rule of law.

It doesn't require that the president do anything overt. Rove is not popular. It does not affect national security.

If they won't do this, they sure won't indict Bush, Cheney, et al.

When you say "if they won't do this, they won't indict bush, ..." are you referring to the Obama admin, Pelosi et al, ...?

As a legal matter, it appears that this matter is subject to interpretation by the lawyers at the DoJ -- which means (and here's where my blood pressure goes up), subject to interpretation by Bush's partisan lawyers who graduated from the fundy colleges and decided against all evidence that it was legal for Rove to ignore a subpoena in the first place.

My concern is that while there are a few Obama appointees in the Justice Dept now, they certainly do not override the illegally hired careerists made up of fundies/partisans who helped construct the interpretations of the law so as to allow Bush, Rove et al to ignore these subpoenae.

Bush's unprecedented post presidential order to Rove now has to go to the courts in order to be determined constitutional or unconstitutional. Because of HIS bs, this may not be prosecuted for a long time.

It is a very real possibility that we may NOT ever get our justice dept back from the corruption of the Bush error. The damage is permanent. There is nothing President Obama can do about the fact that is has been illegally staffed with people who do not care about the constitution, but who in fact serve GOD/RUSH REPUBLICANS/NEOCONS because it is illegal to fire them (!!!! even though they were hired illegally!!!! and their presence violates the very foundation of our justice dept!!!).

They can NOT be fired or replaced. They are there for their entire careers. It was illegal of Bush to do this, but he did it and the people who carried out the orders got off scot free because the JUSTICE dept let them. Well, some of these investigations are ongoing, but Goodling and her ilk are off dancing in some fundy forest after destroying our justice department. A more abhorrent administration we have not had.

It's ironic, but because President Obama DOES care about the law and respects the process, this has to go through the proper channels. It may not come out the way we want it to, through no fault of the current administration.

I urge anyone who cares about prosecutions to keep a close eye on Inspector Fine's various investigations of the Bush dept DoJ, what the ratio of careerists to appointees is, and who exactly is determining the legality of a post-presidential order to ignore a subpoena.

SORRY FOR THE RANT -- but this subject always hurts; Irreparable damage done to our system, and no one notices. Constitutional lawyers say that the damage Bush did to our DoJ will prove to be the most damage ever inflicted on our democracy by any president and will, in history, prove to be the worst of the legacy he leaves behind. And that is saying a lot.

23. When Holder is confirmed as Attorney General, yes.
The Justice Department enforces federal law. Or in the case of the Bush Admin, ignored federal law. You are right, it will be a test of the new administration's fortitude and their dedication to the rule of law to see what they do in this instance.

Prepare yourself for it to be slow, though. As much as I'd love to see U.S. Marshals kick in Rove's door and drag him out in his nightshirt, it will probably be a much more orderly, step by step, even grueling process. The committee votes to cite Rove for Contempt. Then the full House votes for the citation. Then it is referred to the Justice Department. Rove files for an injunction. The courts have to hear arguments. Whoever loses appeals. And then it may be a test of the Judiciary, whether they respect the rule of law or want to play political games in favor of the guy who appointed them.

The Supreme Court might have a tough time with it, politically. Legally, it's obvious Rove is wrong. But politically, the Justices might want to support former President Bush. However, in doing so, they would give President Obama more power. And they don't want that.

I'm gonna stay tuned.

Yeah, enough of this "Gee, can wee arrest him? I dunno, is there a precedent?" crap. Toss his ass in Jail and let bubba make some of the decisions for him. The only decisions that I want Rove to be able to make are deciding whether or not to drop the soap again. Incidentally, I am guessing he will decide yes.

Anyone in the Clinton administration would not have to appear because CLINTON CAME BEFORE *!

If Rove doesn't show up, the Congress should issue a contempt citation post haste. In fact, I would let Rove know that the paperwork to fast track a contempt citation is already in place.
