2. That's just foolish. In many many cases, few if anyone would recognize
that someone is over the legal limit...especially if it's a longterm overdrinker. I suspect MOST people who get caught on a DUI are not visably drunk. The telltale is the test. Now the idiot legislators of NJ are stating that every bartender should somehow KNOW when each patron should be cut off? Yea, right.

3. Breathalysers are cheap
Take keys on entry, store in lock box. Breath test on way out. Fail, no car keys, or keys given to someone who can pass the test and says they will drive. Liability shifted. Job done.

4. This law has been on the books for years in 32 states.

It's called Social Host Liability Law and/or dramshop law or some variation, and also applies to private hosts. Google it.
