Who appointed Patrick Fitzgerald to be Special Prosecutor?

Who appointed Patrick Fitzgerald to be Special Prosecutor?
I don't understand this amicus brief by Robert Bork and Alan Dershowitz et al that Fitzgerald's appointment is invalid because he wasn't appointed by Bush.

Who did appoint Fitzgerald to the job of Special Prosecutor?

Isn't an appointment by the Bush Administration legally an appointment by Bush regardless of Bush's personal involvement?

I still don't see why appointments by the Bush Administration which Bush isn't personally involved in should be considered invalid.

4. IIRC, both Ashcroft and Gonzales had to recuse themselves from this case
If you'll go to the Special Counsel's website at http://www.usdoj.gov/usao/iln/osc/ , it's possible to read the paperwork that was executed when Patrick Fitzgerald was appointed.

7. Comey had full authority to make that appointment
If this amicus is considered, it would throw the whole concept of transferring authority out the window.

10. Until now, it was a given that the president delegated tasks.
Suddenly, when a task is delegated, that is shocking and means Scooter Libby must go free.

5. Hope so - consider the source.
Alan D btw argued on 60 Minutes in 1999 (or 2000?) that torture would be ok given the right circumstances. Doesn't surprise me he's on the neocon team.

6. I think it was after Sept. 11, 2001 that he took that position.
Maybe it would be better if Alan Dershowitz had retired in 2000.

8. No, I distinctly remember it being prior to 9/11
as I gave a speech locally on it. From what I remember, everyone gasped appropriately at the idea. Fond memory that.
