“Scoop” Independent Media - Washington, D.C.

Carol Lam was one outstanding United States Attorney. She nailed down one of the biggest political corruption cases in recent history with a guilty plea from former Republican Congressman Randal “Duke” Cunningham in November, 2005. His crimes included conspiracy to commit bribery, mail and wire fraud.

The San Diego Republican admitted to taking over $1.0 million alone from San Diego defense contractor Brent Wilkes. The jailed Cunningham is now serving an eight year sentence for this and other crimes. In one of her last official acts, Lam indicted Wilkes for bribing former CIA senior executive “Dusty” Foggo, who was also indicted. These crimes allegedly took place over a period as far back to 2002.

A recently released Department of Justice email carried by Talking Points Memo Document Collection (http://tinyurl.com/2k2a79) raises an interesting question. The message is dated”3/7/2005” from leoleonard to MaryBeth Buchanan .....

Was There a Bigger Story to Cover Up?

Maybe there was and it would have been percolating form about the time Lam came on as a U.S. Attorney in 2002 through the April 2005 date listed in the Foggo - Wilkes indictment. What was going on at that time in Lam’s back yard?

According to Brent Wilkes, he was in the ongoing business of doling out money for congressmen in return for favorable consideration ....

I wish to add these speculations, based on considerable independent research.

Regarding Collins' question, "Was There a Bigger Story to Cover Up?"

The BEEF in his story: "... public funds ... were funneled to G.O.P. candidates and causes."

I prefer the generic (leave out "earmarked for national defense") broad scope version. There were $5-6 billion in Medicare and Medicaid funds skimmed too, $1.6B by Senate majority leader Frist's (R-TN) HCA alone. Another $1.4 by Tenet Healthcare, the corporation Lam and HHC were about to cut off from Medicare payments, and Graves and NO TX USA were investigating. Tenet was the subject of investigation in TX where three AUSAs/Prosecutors were dismissed early in the timeline.

In 2006 Tenet hired Gillespie for a cool $360,000, a change in their lobbying firms. Gillespie is considered a 1600 Pennsylvania lobbyist, not a K Streeter. He was Bush's hand-picked RNC chairman.

The Medicare fraud inquiry parallels the timeline with the defense fraud front, and I view them as one front, the $$ Bilking Billions $$ front. This is why the WHY in the Carol Lam firing should remain an open question.

Unlike other USA firings, where election (voter fraud) issues are known and happily spun to the fore, in the San Diego case the debate continues over the reason(s). Corporate fraud charging overlaps on the same days in the timeline of the Sampson e-mail. Less than Wiley, Eagar Republicans have gone overboard promoting the "Coyote" excuse for Lam's firing, including at hearings, where the most complicitous predators in her besmearment were comical in their obvious ineptitude meep, meeping that melody.

Another aspect to investigate is the So NY USA office and the SEC. The SEC settles fraud charging when it involves stock scams. Inflating the stock value of the Hospital corporations with fraudulent high profits and selling off before the stock crashed filled pockedts, including Tenet's chair ($143M) who was fined a cool $1M in a gravy settlement. Note also that the White House just promoted several SO NY USA attorneys to White House counsels.

So, the big picture I see is bilking billions, and defense bilking is just one aspect of the BIG $$BILLIONS$$ bilking!

One last questions: "$$$ Where do the Bucks STOP? $$$"

Cracking down on drugs and pornography was big business in former U.S. Attorney General John Ashcroft’s Department of Justice. When federal prosecutors in California passed on cases involving glass bongs and hard-core sex movies, Pittsburgh-based U.S. Attorney Mary Beth Buchanan swooped in and stole the show.

Critics blasted “Operation Pipe Dreams,” calling the nationwide sting on drug paraphernalia trafficking a waste of resources. Buchanan charged on, though, and in 2003 won a conviction against Tommy Chong — the Los Angeles actor made famous by the marijuana-laced “Cheech and Chong” movies.

That same year, she charged Extreme Associates and the California owners of the porn production company in the first major federal obscenity prosecution in more than a decade. Critics again wailed about resources and the government fiddling with constitutional freedoms.

The Justice Department and Ashcroft praised both cases. Buchanan was rewarded with a string of lofty posts, one of which — director of the Executive Office for U.S. Attorneys — has landed her at the forefront of a congressional investigation into a group firing of fellow Republican prosecutors. ...............

... I am proud of my time as a federal prosecutor and ... I sit on the board and Legal Committee of the Pittsburgh American Civil Liberties Union and in that capacity I lecture to community groups about federal criminal investigations. Often I find myself defending the fairness and integrity of my former colleagues, because I never doubted that the U.S. attorney's office was above partisan politics -- until now.

Recent revelations about White House involvement in the firing of seven U.S. attorneys sickened me, as if I were the parent who had defended a teacher against vicious rumors only to hear him admit that he molested children.

The Bush administration's efforts to use an obscure provision of the Patriot Act to replace U.S. attorneys it deemed too vigorous in investigating Republican officials, too slow in indicting Democratic public officials or too reluctant to investigate "voter fraud" -- a euphemism for attempting to suppress the minority vote -- caused me to re-think my opinion of the fairness of Western Pennsylvania's U.S. attorney, Mary Beth Buchanan. I began to wonder why all of the recent public-corruption investigations in our region have been of Democrats.

The Bush administration has politicized the Department of Justice, just as it has every federal agency. The solicitor general used to be known as "the 10th justice" for his presumed fairness and independence in presenting arguments to the Supreme Court; the current solicitor general is just a mouthpiece for the administration's far-right ideology. Attorney General Alberto Gonzales and his subordinates have disgraced their offices with the positions they've taken to justify torture and the administration's evasion of the Foreign Intelligence Surveillance Act's restrictions, loose as they are, on wiretaps.

Ms. Buchanan has been a devotee of the administration's policies. She has aided the effort to inflate the law-enforcement successes in the war on terror by misclassifying routine immigration and false-document cases as "anti-terrorism cases." .......

Certainly, a central target should be on those who controlled the $$ billions $$ purse-string during the Bushco reign in Congress. That points RIGHT to Jerry Lewis.

7. Each of these targets of investigation could be a spinoff thread onto itself
As context for a comment, I breezed through and aced a Masters degree's worth of graduate seminars, even one with an infamous full file drawer of academic articles to read. The corruption investigations of this administration are so myriad and complex that they would be too much work for a mere Masters degree!!

Anyone who can master this in its totality should be granted several Juris doctorates.
And, it is time for a House Committee to hire quite a few dozen of those.

There is yet another United States attorney whose abrupt departure from office is raising questions: Debra Wong Yang of Los Angeles. Ms. Yang was not fired, as eight other prosecutors were, but she resigned under circumstances that raise serious questions, starting with whether she was pushed out to disrupt her investigation of one of the most powerful Republicans in Congress.

If the United States attorney scandal has made one thing clear, it is that the riskiest job in the Bush administration is being a prosecutor investigating a Republican member of Congress. Carol Lam, the United States attorney in San Diego, was fired after she put Randy Cunningham, known as Duke, in prison. Paul Charlton, in Arizona, was dismissed while he was investigating Rick Renzi. Dan Bogden, in Nevada, was fired while he was reportedly investigating Jim Gibbons, a congressman who was elected governor last year.

Ms. Yang was investigating Jerry Lewis, who was chairman of the powerful House Appropriations Committee. Ms. Lam and most of the other purged prosecutors were fired on Dec. 7. Ms. Yang, in a fortuitously timed exit, resigned in mid-October.

Ms. Yang says she left for personal reasons, but there is growing evidence that the White House was intent on removing her. Kyle Sampson, the Justice Department staff member in charge of the firings, told investigators last month in still-secret testimony that Harriet Miers, the White House counsel at the time, had asked him more than once about Ms. Yang. He testified, according to Congressional sources, that as late as mid-September, Ms. Miers wanted to know whether Ms. Yang could be made to resign ...

... The way to put to rest the questions about Ms. Yang’s suspicious departure, and the firings of the other prosecutors, is to require that Ms. Miers, Mr. Rove and other White House officials tell what they know, in public and under oath.

Abramoff and Scanlon were convicted of conspiring to bribe public officials more than a year ago, but the court has postponed the sentencing of each several times.

During a Senate Judiciary Committee hearing in April, Whitehouse forced Attorney General Alberto Gonzales to admit previous firewalls between White House and DoJ staff had been torn down, allowing at least 400 White House officials and over 30 Justice officials to have discussions with one another about criminal cases.

Whitehouse told ThinkProgress why that matters:

WHITEHOUSE: So a Karl Rove to Kyle Sampson call about a case would have been out of bounds under the rules that had been developed for decades. Under the Bush Administration, they knocked down the rules, so there’s so many opportunities for that infiltration it’s hard to know where it came from. The Tenet connection is fascinating. Now we're into some interesting territory. Wonder whre did Tenet get the money to start or buy that company?

I have not reviewed the business fraud element as much as you have but it's fascinating.

What's the connection between Foggo and Teneet, if there is one. Or Goss and any of these
highly questionable practices.

Have you read Joseph Cannon's two pieces on Wilkes. The links are at the end of my article.
He showed how some Wilkes subsidiaries simply lacked any products other than a web page.

So money paid for products was diverted directly into something, who knows what according to Cannon.


Here's an excerpt from Wilkes, the Invisible Empirei

The invisible empire. I still have yet to discover any evidence that the other "defense-related" enterprises operating under the Wilkes umbrella were genuine businesses.

"Group W Media," the advertising agency with no discernable clients, was a front for something -- I don't yet know what. "Group W Transportation" amounted to a time-share arrangement involving a Lear jet. "Al Dust Properties" and "Group W Holdings" supposedly owned properties -- but I can't trace any holdings beyond the impressive building which the Wilkes Corporation called home. (It's now up for auction, by the way.) MailSafe Inc. supposedly offers "mail decontamination, digital capture, and electronic distribution to government and commercial entities." But the web site has disappeared, and the company seems to have left zero imprint on corporate America. Where is the evidence that it actually provided any services to clients?

(That page is really little more than a ghost, since the official Wilkes Corp. site no longer points to it.) Look closer: The site does not specify any PerfectWave products. Neither do we encounter any named personnel or development teams. No order information. If this company makes battlefield-ready high-tech equipment, why doesn't the the web site mention any departments, managers or employees? All we get is a single phone number and a fax number. Now conduct a Google search: Aside from channeling funds to politicians, PerfectWave hasn't done anything to warrant a mention.

10. Stock prices and insider trading are issues in the Medicare Fraud scheme.
And that is how the SEC and the So NY USA gets into the picture. Tenet's chair made $143 million, higfest paid CEO in history then, because the price of the stock climbed and his pay was performance based. The performance of the stock was due to the income from stealing billions from the taxpayers.

Any investigation of this matter must eventually reach to every stock transaction in their stock. The potential for peripheral enrichment without the direct bribery and corrupt practices is overtly obvious. The insiders knew the stock climb was a big scam based on a fraud. They sold before the crash, to the unwitting suckers viewing the corporation's stellar "earnings." This is "clean hands" white collar crime, unlike the Cunningham bribery case.

A lot of stock portfolios were swindled. "Where did the Bucks STOP?"

No, the Chairman of Tenet made that much, $143 million, and was fined $1 million. BWAAAA. And the soft landing for the crime was brought to you by Bush's appointed SEC, USA and HHC, etc., with come minor adjustments in personnel along the way, like Carol Lam's firing.

No, Tenet defrauded $1.4 BILLION $$$$$$$$$$$ with the BIG "B," as in BILLIONS and BILLIONS.
And they are not #1 healthcare defrauder. #1 is Republican majority leader Frist's Company.

DoJ put an end to USAs charging corporations with fraud except with approval from Politics Central.

As U.S. attorney, Lam took an interest in the case of San Diego's Alvarado Hospital Medical Center, which was owned by Tenet Healthcare Corporation, the nation's second-largest hospital chain. An internist told investigators he had received cash bribes from the hospital in exchange for referrals., June 11, 2004. In 2002, government agents raided the hospital. In June 2003, the hospital's chief executive, Barry Weinbaum, was indicted on one count of conspiring to violate the federal anti-kickback statute and seven counts of offering and paying illegal remuneration. The hospital and a Tenet unit were indicted a month later.<9> Trial began in 2004. On February 17, 2005, a mistrial was declared when the jury failed to reach a verdict. A second trial began later that year, with Lam personally prosecuting the case this time. After seven months in the courtroom plus a record four months of jury deliberation, a judge declared another mistrial on April 4, 2006.<10> The two losses were a major blow for Lam, who staked her reputation on the case and was rumored to have passed up a settlement worth tens of millions of dollars.

Facing the prospect of a costly third trial, Tenet settled its case with the federal government. Denying that it paid kickbacks to doctors for referrals of patients to Alvarado, Tenet paid $21 million to the government and agreed to shut down Alvarado Hospital.<11> As a condition of the settlement, Tenet admitted that the case has led to "significant reforms" at hospitals around the country, and that the company had been "distressed" to learn of "excessive payments" to some doctors.<12> Weinbaum's attorney, Charles La Bella, said the statement was a face-saving effort by Lam, who had forced it down the company's throat: "Anyone who knows how invested she was in the case, and anyone who knows how she believes this was a personal defeat for her, will know this statement was dictated by Carol Lam."<13>

27. Enron, Tenet, how many billions lost to fraud? The Congressional Committees
need to start hiring more counsels, prosecutorial investigator types. This will happen if Gonzales does not have the grace to remove himself early Monday. Even if he does, the Congress must do their own investigations because absolutely no trust remains in the Bush Justice chain-of-command. And, special prosecutors must be appointed immediately by the new acting Attorney General to ensure some degree of trust and to expedite investigations.

I'm expecting an interesting week in the history of the Department of Justice.
