The Oversight Committee has been investigating whether White House officials violated the Presidential Records Act by using e-mail accounts maintained by the Republican National Committee and the Bush Cheney ‘04 campaign for official White House communications. This interim staff report provides a summary of the evidence the Committee has received to date, along with recommendations for next steps in the investigation.

The information the Committee has received in the investigation reveals:

... White House officials given RNC e-mail accounts ... at least 88 ... RNC e-mail accounts include Karl Rove ... Andrew Card ... Ken Mehlman...

...White House officials made extensive use of their RNC e-mail accounts. The RNC has preserved 140,216 e-mails sent or received by Karl Rove. Over half of these e-mails (75,374) were sent to or received from individuals using official “.gov” e-mail accounts ... Sara Taylor (66,018 e-mails) ... Scott Jennings (35,198 e-mails). These e-mail accounts were used by White House officials for official purposes ...

... There has been extensive destruction of the e-mails of White House officials ... RNC has preserved no e-mails for 51 officials ... there are major gaps in the e-mail records of the 37 White House officials for whom the RNC did preserve e-mails ... only 130 e-mails sent to Mr. Rove during President Bush’s first term and no e-mails sent by Mr. Rove prior to November 2003 ...

... evidence that the Office of White House Counsel under Alberto Gonzales may have known ... but took no action to preserve these presidential records ...

... it is not possible to determine precisely how many presidential records may have been destroyed by the RNC ...

... the records of federal agencies should be examined to assess whether they may contain some of the White House e-mails that have been destroyed by the RNC. The Committee has already written to 25 federal agencies ... they may have preserved official communications that were destroyed by the RNC.

... the Committee should investigate what former White House Counsel Alberto Gonzales knew about the use of political e-mail accounts by White House officials. If Susan Ralston’s testimony to the Committee is accurate, there is evidence that Mr. Gonzales or counsels working in his office knew ...

... the Committee may need to issue compulsory process to obtain the cooperation of the Bush Cheney ’04 campaign ...

Waxman has been one very busy Dem. No doubt, he was preparing for much of this for years.

After three congressional investigations – the investigation into Jack Abramoff’s contacts with the White House, the examination of politicization of the General Services Administration, and the investigation of the firings of eight U.S. Attorneys – brought to light the White House’s extensive use of nongovernmental e-mail accounts to conduct official business, the Committee directed the RNC and the Bush Cheney ’04 campaign to preserve e-mails to or from accounts held by White House officials.

6. Imagine the size of the Hatch Act net, with half of the Rove e-mails from dot.gov accounts
Any person (under Hatch Act jurisdiction) conducting political campaigning using a dot.gov account or any account while on duty at a USG job can lose their job or, at a minimum, be suspended for 30 days.

I wonder how many of the ones they no longer have are to be found on other servers, esp. USG servers where everything is backed-up? Another 100,000?

Karl sure has been communicating a lot. And, how often do the e-mails say, "George said...."? This may be way bigger than the Nixon tapes.

either the Hatch Act or the Presidential Records Act? Not everyone is such a loyal Bushevic to be willing to destroy their career.

And Frank Langella called me, playing Nixon, and said, “How would you describe the way Richard Nixon walked,” because I had done so many interviews with him. 31. This may happen, mostly, for Hatch Act violations the minimum is a
30 day suspension. The big story within the story is Gonzales knew and did nothing about Presidential Records Act violations. This goes to conspiracy. That conspricy was evidenced in e-mails mentioning to use non-WH accounts to avoid the preserving of messages.

..... we are therefore formally requesting that you provide promptly to our Committee all e-mail communications (including all meta-data relating to those communications) by any Government employee stored on or in any way retrievable from the RNC servers or in the possession, custody or control of the RNC, including any of its affiliated entities, that relate in any way to the recent termination of U.S. Attorneys, as well as all e-mails that relate in any way to any of the following related subjects: the performance of any U.S. Attorney; any consideration of whether to retain, dismiss, or seek the resignation of any U.S. Attorney; any candidate for possible appointment as a U.S. Attorney to replace anyone considered for termination; and any process for considering any of these subjects. Among the White House officials who we believe may have used RNC-affiliated e-mail accounts for these purposes are Karl Rove, J. Scott Jennings, Sara Taylor, and former White House officials Harriet Miers and Tim Griffin. But there may well be others, and we would ask that you provide them all.

We also request any other types of records of communications involving any current or former White House official involving any of these matters that are in the possession, custody, or control of the RNC or any of its affiliated entities. And in light of reports that some of the e-mails may have been deleted, we also request any information in the possession, custody, or control of the RNC or any of its affiliated entities, electronic or otherwise, including meta-data,

that might indicate when and for what periods any of those e-mails were deleted, or who may have been involved in deleting them. To the extent that you take the position that deleted e-mails cannot be retrieved, we must insist that, at the very least, technical experts working with us have the opportunity to question and work with RNC personnel to seek such recovery.

We understand that the White House has asked you for all e-mails by or to White House officials that are stored on or retrievable from RNC servers. Our request is narrower, specifically limited to e-mail and other records relating to the U.S. Attorney matters we are investigating, as described above. Particularly as these e-mails have already gone outside the confines of official White House communications channels, we would ask that, whatever you may be doing to respond to the White House request, you treat our request as separate and provide the materials we have requested directly to us, as quickly as possible, rather than diverting them into a White House review of the larger set of e-mails and thereby delaying our receipt of them. ...

35. New amendment -- Elected officials who use non-government servers...
to house government emails during a time of war must provide full copies of said emails within 24 hours of request by a legislative representative who presents < x > of co-sponsors for the request.

All emails that seem to be of legitimate purpose and that do not indicate any malfeasance against laws or the public interest by the official shall be held in confidential status within an appropriate committee.

If they do not provide said copies then the server will be seized by the legislative branch and an investigation into their non-compliance and reasons for non-compliance will begin and the defendant will be immediately remanded to jail for suspected treason against the United States of America.

Once the server is in possession by the legislature anything on it can be used as evidence in the trial and as reasonable cause to investigate other officials using the same server.

Any attempt to deny the public reasonable access to investigate subversive behavior by government officials during a time of war shall be punishable by fines, jail time and in certain heinous offenses, death. In other words, those who shield treasonous war criminals will be subject to the same level of punishment as if they had themselves committed the crime.


BRING BACK THE FREEDOM OF INFORMATION ACT AND GIVE IT TEETH, CLAWS A GUILLOTINE AND A BAD ASS ATTITUDE.

New evidence unearthed by House Democrats establishes that White House political adviser Karl Rove and many of his colleagues used Republican National Committee e-mail accounts for official business -- even though White House policy is clear that doing so is a violation of the Presidential Records Act.

How did such casual lawbreaking come to be so widespread? And why was it tolerated? Those are among the questions the White House has yet to answer satisfactorily.

One reason for Rove's use of the RNC e-mail account would appear to be convenience.....

Another reason, suggested by White House spokesman Scott Stanzel in April, is that some people may have used their non-government accounts for official business due to "an abundance of caution" in order to avoid violating the Hatch Act...

Yet another possibility, of course, is that Rove and the others chose to use the RNC e-mail accounts for official business as a way to keep their e-mail from public scrutiny ... they appear to have succeeded ... RNC automatically deleted most e-mails after 30 days and allowed users to manually delete whatever they felt like. The result, as I first reported in April (http://www.washingtonpost.com/wp-dyn/content/blog/2007/04/12/BL2007041200941.html), is that countless White House e-mails are now missing .

... "the RNC has preserved no e-mails for 51 officials," said the interim report, issued by committee chairman Henry Waxman, D-Calif.....

The 51 include Ken Mehlman, a former White House political director ....

"Given the heavy reliance by White House officials on RNC e-mail accounts, the high rank of the White House officials involved, and the large quantity of missing e-mails," the report said, "the potential violation of the Presidential Records Act may be extensive."

Republicans said there is no evidence that the law was violated ....
