... and the Supremes side with the Dictator and his Ship, how will you feel, KNOWING that a President Gore would never have gotten us here?

5. I was listening to John Dean and he said there was a flaw in our system
Edited on Thu Jun-28-07 07:55 PM by Horse with no Name
that needs to be corrected.
It is the responsibility of the Justice Department to serve the subpoenas. IF they don't serve them (and we have no legal recourse to force them to do so), then basically they just sit there.
The ONLY weapon we have is political pressure OR legislation. Neither of those will happen.
So basically, the subpoenas will sit on Alberto's desk. They will not be served unless Congress pressures him to do so and I just don't see that happening because LEGALLY he doesn't have to.

On edit:
A hell of a flaw, wouldn't you say?

7. That can only be appointed by Justice
You see where this is going, right?
Impeachment is the ONLY answer. It's the ONLY power that Congress has solely that isn't dependent on another branch to carry out.

8. there's no special-prosecutor law anymore
if the Justice department doesn't appoint one, there's no provision for forcing one.

2. I don't know how it will come out of SCOTUS
If they are strict constructionists as far as the Constitution goes, the Unitary Executive theory won't hold up.

3. Not sure what you mean?
Congress will have to go to the courts to force the Pres. to abide by the subpoenas. When it reaches the Supremes, ScalitoRobmas will side with the Pres. just like they agreed when they were nominated.
Let's all than Joe LIEberman for making sure the Dems couldn't block Alito.

9. worst case, then what?
OK, let's say either the Justice Dept. refuses to act, or if they do, then SCOTUS finds that Bush/Cheney have kingly powers previously unfound in the Constitution.

Realistically, what should we, as plain citizens do? I'm ready to DO SOMETHING. But what?

I used to have such contempt for the Germans for allowing the Nazis to take over. I still hate that it happened, but I'm beginning to understand it.

Really, let's think of some specific acts we can execute.

10. boggles my mind when I consider that the so-called "liberal" SCOTUS
decided that Clinton had very few rights to privacy when it came to "contempt of " and "impeachment" ...
