The constitutional issues raised in the couple's suit hinge upon the court's interpretation of two pieces of federal legislation, the Privacy Act of 1974 and the Intelligence Identities Protection Act of 1982, according to Duke University law professor Erwin Chemerinsky, who will argue the appeal.

The Intelligence Identities Protection Act, Chemerinsky said, is a criminal statute, and "no court has ever said that a criminal statute precludes a civil suit for money damages."

Cotchett said his legal team plans to take the case to the U.S. Supreme Court if the U.S. Court of Appeals for the District of Columbia Circuit turns down its appeal.

3. Hmm. The only reason Roberts would hear it
Would be to declare that no agent should ever be protected if the president was against such a thing.
