64. I have made mistakes. I have apologized. I even called Conyers office and apologized.
His office was ecstatic. At least the person I spoke with was nice and said she appreciated my words, once they figured out why I was calling...;-)

I am one of those that was getting tired of the rhetoric and saw compicity in their inaction. But, I never heaped scorn on fellow DU'ers and if I did I tried to recant or apologize. Hell, I have even been called "insincere" for apologizing...

I wish you the best and hope that others who were wrong about Conyers do the same as I and realize that it takes more courage to say you were wrong than to remain silent, regardless of what some DU'er who you have never met says about you. Even if they compare you to Bush, take the high road and apologize. There is nothing wrong with humbling oneself before the masses.

My own post date back more than 24hrs...and they were not snarky...just plain ignorant ;-) I have probably been ignored by quite a few...but thanks to the few at DU who kept trying to educate me, I learned about the process and actually began to see where I was getting it wrong.

That is why I never take offense when someone calls me ignorant. Ignorance is curable.

I think that Bush's next step is to get all this into the courts and up to the Supreme Court as fast as possible. His lawyers will argue that Executive Privilege trumps everything, or even that Congress has no oversight powers at all, only advisory. Then the question is just how reactionary is the Alito court? Will they vote 5-4 to install a "Unitary Executive"?

E.P. can't not be used to obstruct investigation of a criminal matter. If Bush tries it, he will also be obstructing justice. I suspect this is what Arlen was splainin to him on A.F. 1 today.

In fact, Congressional investigative powers are at its peak when probing whether executive branch officials have committed criminal conduct. This probe is a type of "criminal proceeding" because Congress is investigating "suspected illegal conduct" or "alleged abuses of authority" (pdf file) at hearings in which people testify under oath or face potential contempt, including the possibility of jail time. The investigation is valid as long as Congress is considering potential legislation to address or remedy the alleged misconduct of executive branch officials.


It's been about showing there was need for a CRIMINAL INVESTIGATION - laying ground work for same. They beat King george's privilege assertion and give him a swift kick to the balls.

Look at the Libby trial. That judge was a Bush (SR) appointee. That didn't work out too well, did it?

Say they go to court, and get a ruling against them. They appeal, and get another ruling against them.

If they go to the Supremes, and they overturn, it will be seen as a political payback. Especially when these "strict constructionists" suddenly get less strict to accomodate their li'l buddy.

Yes, the Bush government wants this thing in the courts -- but not as soon as possible. In fact, I think they want it to go as slow as possible. Otherwise -- yeah, the question will be about the wartime powers of the unitary executive.

Bush v. Gore held that, just this one time, the "law" says that Bush wins the White House. There is a chance that the Roberts Court will say, just this one time, the "law" says Bush does not have to answer to Congress.

I really don't know what Roberts and Scalia are capable of doing -- but if anybody tells you that they know for sure that they wouldn't pull another Bush v. Gore type of travesty out of the bottom of their robes is lying to you. These are weird times -- even weirder than the 60s. Who knows how weird it is going to get yet?



It will come down to impeachment, any way. Even in the Supreme Court rules against him, Bush will not give in. It is not in his nature to give in -- he is a weak and foolish man who confuses stupid stubbornness with the strength of character that he has never had.

He will also end up in prison some day. He'll probably die in prison.

The stakes are increasing but these people have very little to loose by going all in. If Rove went in and gave a truthful testimony it would destroy this WH. Ditto for Miers and Gonzo. The strategy will be to bluff by obfuscating and making indefensible assertions of EP until impeachment and investigation by special prosecutor are the only remedies against them.

IMO this is going to screw them though, because the info is bleeding out now, and every new detail uncovers 3 new scandals or potentially criminal acts. Once all the investigations have concluded and indictments are filed, King George the Mad may not be around to issue pardons anymore.

a brief news conference -- CNN covered it and cut it off as soon as Feinstein got up to speak. They then went back to Wall Street news. Apparently the market it tanking today.

Leahy's announcement was from the Senate floor and therefore, covered by C-SPAN2.

Otherwise, the MSM is pretty much minimizing or even ignoring the stories.

If this ever gets to court, a court would decide whether executive privilege applies based on the needs of Congress. Impeachment would create the strongest showing of need. In that case, the courts would be least likely to rule in Bush's favor.

The fact that an impeachment is underway does not bar Bush from claiming executive privilege.
