If Gonzales Resigns During the Vacation ....

If Gonzales Resigns During the Vacation ....
... of the Senate in August, does that mean Bush can appoint a replacement who can serve until January 2008?

The Constitution says in Article Two; Section Two; Clause 3:
The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.


It seems to me that one way out of this growing Justice Department scandal would be for Bush to jettison Gonzo, appoint another loyal flunkie, make propaganda claims about a fresh leader at Justice, and then protest that Congressional investigations are unnecessary since the new guy wasn't part of the Gonzales problems.

If that can happen, Bush avoids the problem of confirmation hearings for a new AG, at least until next year ... and he can hope that the heat will have cooled off by January. (Besides, we'll probably be in a war with Iran or have a collapsed economy by then and who will care about the Justice Department.)

Am I right?

Or am I missing something?

I doubt there will be a resignation; the recent FISA vote will probably serve to deflect attention from AGAG's woes.

5. I've been concerned about that as well.
And I somehow doubt that Reid will actually grow a spine and follow up on his announced intention to have a session in the Senate every 10 days, in order to prevent recess appointments. These idiot traitors just sold our civil liberties so they could go on vacation-- I hardly think they'd cancel just to prevent a recess appointment.

8. If Gonzo submits his resignation but says he will stay on until the next AG is confirmed ...voila!
Bush gets to keep Gonzo in place to continue playing defense for him PLUS Bush gets to blame the Senate for not confirming his nominee(who might be even worse than Gonzo, if that is possible).

THis would work if Reid kept the Senate from adjourning by having a pro forma opening of the Senate every 9 days until Sept.

Seriously, there is no chance at all that he will resign, with the possible exception of some sort of real health emergency. And even in that case (see Tony Snow, for instance) he would probably just take a short break instead of resigning.


Gonzo is one of the main "F**k you, we are the Masters" signs that this Admin has. There is no way they will give that up, they enjoy this kind of stuff. And they know that the lapdog congress will never remove Gonzo. Never.
