Van Hollen: Prosecutors will appeal ruling in necrophilia case

MADISON, Wis. (AP) - Prosecutors will appeal a ruling that dismissed charges against three men who dug up a young woman's corpse to have sex with it after seeing her obituary photo.

A state appeals court ruled last month that Wisconsin has no law that criminalizes necrophilia, the act of having sex with a dead body. The court says a judge was correct to dismiss attempted sexual assault charges against twin brothers Nicholas and Alexander Grunke and Dustin Radke.

Prosecutors say the three went to a southwestern Wisconsin cemetery last September to remove the body of a 20-year-old woman who had been killed the week before in a motorcycle crash. The men dug to her burial vault but abandoned their plan when a vehicle drove into the cemetery.

Attorney General J.B. Van Hollen says the Department of Justice will ask the state Supreme Court to reinstate the charges. He says he believes Wisconsin's sexual assault law applies even in cases where victims are dead.

Ok, I don't disagree, but there are a lot of other things that need defending in Wisconsin too.

2. This was in the southern part of the state.
In the northern part, there was an incident with a 20 year old guy and, um, road kill. That's not illegal either... its just :scared:

That is truly depraved. Hard to believe anyone could be that sick.

Maybe they are young republicans. That would explain it.

5. They were not able to get to the body
because there was a cement slab in the way.

I guess there's gotta be a law.
