Fresh Air from WHYY, September 7, 2007 · As head of the Justice Department's Office of Legal Counsel, Jack Goldsmith led the team of lawyers that advises the presidency on the limits of executive power. During his tenure, he battled the Bush White House on the now-infamous "torture memos," as well as on issues of surveillance and the detention and trial of suspected terrorists. Goldsmith resigned his post after nine months.

He's speaking publicly for the first time about why he resigned in a new memoir, The Terror Presidency — which also recounts what he witnessed in Attorney General John Ashcroft's hospital room, when Alberto Gonzales and Andrew Card, the White House chief of staff, demanded that an ailing Ashcroft approve a secret program that was about to expire. Goldsmith was among those who objected to the program.

1. I heard that interview. Carefully nuanced; no real
outrage on Goldsmith's part.

2. I agree - he sounded like a right wing nut that just wanted the "proper legal cover" and not poorly
done Justice Department memos.

Interesting the the 9/11 "emergency" giving "emergency war time powers" to the President is renewed every year by the President.

Also the assertion that King like powers (my wording) are what the emergency powers are all about, and the assertion that the Suppreme Court and Congress have agreed that Bush has those King like powers. Indeed he seemed quite proud that all future Presidents would have this greater power because the forever war on terror would never end - feeling the "rapid response/rapid decision making required" intrusive spying on all Americans and the end of the court system whenever the president chose to not follow the law.
