"In a rare intervention of a civilian court in the military justice system, U.S. District Court Judge Benjamin H. Settle granted the emergency stay shortly before close of business Friday. Watada's trial, slated to begin at 9 a.m. Tuesday, is now postponed until at least Oct. 26, the judge ruled."

4. Looks like it is...
Seattle Post-Intelligencer, Oct 6, 2007

"A federal judge in Tacoma has delayed the court-martial of 1st Lt. Ehren Watada, who refused to deploy to Iraq.

In a rare intervention of a civilian court in the military justice system, U.S. District Court Judge Benjamin H. Settle granted the emergency stay shortly before close of business Friday. Watada's trial, slated to begin at 9 a.m. Tuesday, is now postponed until at least Oct. 26, the judge ruled.

In the meantime, Settle intends to hear arguments whether the court-martial would violate Watada's protections against double jeopardy. His first court-martial earlier this year ended in a mistrial."

5. Emergency stay - double jeopardy.
It ain't over yet, but this is definitely good news.

A civilian judge stepped in to keep the military from rail-roading Watada.

Fucking aye!

9. This NEVER would have happened in the VietNam era -it's a positive sign that
the courts (or at least this judge) isn't in lockstep with the government's BS. I'm so proud to be from that area! Looking forward to following this. Thanks for the post.

11. I believe we're seeing sanity leaking through.
The soldiers are speaking up about Limbaugh. And now this.

The truth has been suppressed. But it exists. And we're beginning to see it.

14. This is great!
It gives the dumbass pricks a chance to bow out gracefully, save face.
I hope they're smart enough to recognize this fact, take their ball and go home. (And wait long enough for the l-t to decompress and decide that going after the crud heads might be a good way to serve the country and get in a lick or two of his own.)
