Bush to Deride Approval Process for Judicial Nominees

Nov. 15 (Bloomberg) -- President George W. Bush, in a speech tonight, will say the confirmation process for federal judges has become a ``license to ruin the good name'' of nominees and will deride what he says has become a trend toward judicial activism.


``The Senate is no longer asking the right questions,'' Bush will tell the Federalist Society, a Washington-based group of conservative and libertarian lawyers, according to excerpts released by the White House. ``Nominees are asked to guarantee specific outcomes of cases that might come before the court.''

Bush is pressing the Democratic-controlled Senate to fill U.S. appeals court vacancies before he leaves office in January 2009. Patrick Leahy, the Vermont Democrat who chairs the Senate Judiciary Committee, said in September that only nominees with the support of both Republicans and Democratic Senate leaders will be confirmed. There are 14 federal appeals-court vacancies, and five appellate judges have been confirmed so far this year.

Bush, in his remarks tonight in Washington, will suggest that the Senate is falling short of its constitutional duties by failing to confirm more of his nominees. Congress must ``meet its responsibilities and resist the temptation to encroach on the powers the Constitution accords to the others,'' he will say.

Holsinger is resigning before the end of his term. A source in Wilmore tells Bible Belt Blogger that Holsinger is resigning because he expects to be recess appointed as Surgeon General:

Holsinger’s nomination, opposed by several leading Democrats, has stalled in the Senate Health, Education, Labor and Pensions Committee. But Holsinger is telling people the president plans to appoint him to the post anyway once the Congress goes into its holiday recess.


Holsinger has come under intense criticism for his long history of prejudice toward gays and lesbians. He founded a church that “ministers to people who no longer wish to be gay or lesbian” and “opposed a decision to allow a practicing lesbian to be an associate pastor” in the United Methodist Church. In 1991, he also authored a graphic document arguing that gay sex is “intuitively” unnatural and can lead to “lacerations, perforations and deaths.”

Last month, ThinkProgress noted that three months after his July hearing, Holsinger has still not responded to a Senate health committee follow-up questionnaire. Without his answers, the committee has not scheduled a vote on his nomination. Looks like the committee might never receive a response from Holsinger now.

6. The White House just springs these nominees on Congress,
without any advance notice to give adequate time to properly check them out. Congress should Deny each and every one until a proper investigation has been completed. At the same time Congress should allow "recess appointment" only as they are written in the law. bu$h is abusing the law on recess appointment and getting away with it.

9. When bush took office there were over 200 vacancies
more than had ever been in the judiciary system. Why. Because the republican controlled senate had turned down practically all the nominees that President Clinton had made. And to this date all the position were filled.

Why in the S.O.B.hell don't the democrats come back with this stuff. They never ever in any way defend themselves. No wonder the public doesn't know what is going on.
