DID BUSH VIOLATE COURT ORDER - Federal judge asks - Hearings Mandatory!Judge orders hearing on CIA torture tapes.

AP reports:

A federal judge has ordered a hearing on whether the Bush administration violated a court order by destroying CIA interrogation videos of suspected terrorists.

U.S. District Judge Henry H. Kennedy rejected calls from the Justice Department to stay out of the matter. He ordered lawyers to appear before him Friday morning.

In June 2005, Kennedy ordered the administration to safeguard “all evidence and information regarding the torture, mistreatment, and abuse of detainees now at the United States Naval Base at Guantanamo Bay.”

4. Seems he saw the CIA gambit (transferring detainees from Gitmo) in March, 2005:
and moved to maintain some judicial oversight.


Federal judge bars US from sending detainees abroad without notice

US District Judge Henry Kennedy issued a preliminary injunction Tuesday ordering the military to give detainees' lawyers 30 days' notice before transferring a detainee from Guantanamo Bay to the custody of foreign governments, allowing time for the transfer to be challenged. After considering whether US courts have jurisdiction to oversee decisions about where to move Gitmo detainees, Judge Kennedy said he was preventing transfers without advance notice to bar the government from "unilaterally and silently taking actions" to move detainees outside the reach of US courts.

5. Wow! Justice Kennedy actually has principles
and cares about the law. It's just a shame that this is even news - this is how every justice should practice.

Kudos to Kennedy for doing the right thing. A rueful K&R as our reaction to this news demonstrates how politicized our courts have become....
