HELP ME,DU! My "top" employee takes cash bribes from my competitor's "representatives",
Edited on Thu Jan-03-08 04:32 PM by elehhhhna
...he also accepts luxury vacations, the use of private planes, sports tickets, meals and gifts, under the guise of educating himself. He brazenly solicits contributions to his own personal "charity" and appears to be openly negotiating for his NEXT job, by giving generous terms to my suppliers, etc. I've caught him lying to me time and time again...over the course of several years.

Whatever shall I do?

9. Look for an employment lawyer.

If he's built up a sizeable bankroll he will fight to keep it. You should get in the first licks first.

16. Depends on what the employment laws are in your state
If you are in an "at will" state, you don't need a reason to fire him. However, document whatever you can first, then fire his ass. Always better to have documentation in case of a dispute.

24. I'm pretty sure it is
I work in DC, and have been told it is an "at-will" state. However, I would still document everything you can to protect yourself. You could also fire as part of a "reorganization", in other words, tell the employee that his job has been eliminated. You can then change the job description and hire somebody else.

I found a few links for you:

http://employeeissues.com/wrongful_termination_2.htm

http://employeeissues.com/fired_job.htm

http://smallbusiness.findlaw.com/employment-employer/employment-employer-ending/employment-employer-ending-firing-faq.html

So it looks like you can fire the employee unless you have a contract with the employee, except for race, disability, military service, and a few other reasons. Of course, if the employee breached the contract through his actions, you can still fire as long as you document.

Not a lawyer, and its always best to check with an employment lawyer.

19. Ask him for a cut or
You will Employee? (hire) His worst Competitor (carrot / stick ) and you both might make work? and you will get some money from competition) and give him the accounts

Or - Offer Partner? and now its his best interest (offer non competitive - contract) to make firm money.

Or Fire him on his Birthday!!! (after he spent a ton of the money - on himself - and will beg to get his Job Back...and owe you big time.)

20. Depends... is it legal?
Depends... is it legal? Is it an established practice? Is this employee the only one doing it? If so, why hold this one employee to a standard no one else is held to?

You are ever so clever. I hope to one day be just like you after you've grown up...
