SCALIA Sides With BUSHCO: "Some torture may not be "cruel and unusual punishment"
Last Updated: Tuesday, 12 February 2008, 04:02 GMT

US judge steps in to torture row

"Some torture may not be "cruel and unusual punishment", says Scalia
The most outspoken judge on the US Supreme Court has defended the use of some physical interrogation techniques.

Justice Antonin Scalia told the BBC that "smacking someone in the face" could be justified if there was an imminent threat.

"You can't come in smugly and with great self satisfaction and say 'Oh it's torture, and therefore it's no good'," he said in a rare interview.

He also accused Europe of being self-righteous over the death penalty.

5. Scalia one of *'s thugs.
TORTURE is illegal when will they get it? Or maybe when it's practiced on our soldiers all hell will break loose.

6. I cannot help but think
That minus two or three fingernails, and once drowned and revived,
that Tony might see it a more traditionally American way.

Torture does not work, Tony.

8. WTF?
"If you took a public opinion poll, if all of Europe had representative democracies that really worked, most of Europe would probably have the death penalty today.

"There are arguments for it and against it. But to get self-righteous about the thing as Europeans tend to do about the American death penalty is really quite ridiculous."

-------------
Has Scalia seen the public opinion polls on impeaching Bush and Cheney in his own representative democracy?

Scalia is a public embarrassment.

10. Other things Scalia said:
"Torquemada had it right..."

"Nothing says 'I love you' like thumbscrews."

"I think Iron Maiden is great. I have one in my basement."

"Ilsa, She-Wolf of the SS had it right..."

"All my cats have nine tails."

"There's no good reason why the right kind of person shouldn't be relieved of their fingernails."

"You want cruel and unusual? Clay Aiken's latest album... That was torture!"

11. So is he defining torture as "smacking someone in the face"?
If so, then waterboarding far surpasses that and by stating that smacking someone in the face is torture, he is saying that waterboarding is also torture in a more extreme form.

Thus, contrary to statements that have been presented by prior administration toadies, waterboarding is torture, and is illegal under US Law, the UCMJ, the Geneva Conventions, and all forms of law which the US is bound by.

I'm betting the Scalia family reunions resemble something out of the Spanish Inquisition meets the Godfather...

i couldn't listen long.
also went on about a long time in prison might be cruel and unusual punishment as a sentence for someone found guilty of a crime, but judges send witnesses to prison until they give up their information ALL THE TIME.
and how the united states constitution doesn't apply everywhere.
omg.

19. It's only natural, the man doesn't believe in democracy or counting the votes so
torture would be a logical progression to such a mentality.

Thanks for the thread, kpete.

22. OK, Big Tony.....get set to get waterboarded!
If you think some kinds of torture are OK...I have a great idea. Let's think of all the things that BushCo has done to people ~~ in the name of "terra" ~~ and let's try them out on you so that you can PERSONALLY speak to the issue of what is and what is not torture. I say start with waterboarding and then let's make a pile of naked, shit covered people with you on the bottom.

Anyone else have any methods they think that Big Tony should PERONALLY investigate?
