another bu$h* judicial nominee- no qualifications and questionable ties
a top attorney for corrections corporation of america who has NEVER been a judge and has LITTLE trial experience is the bu$h* nominee for federal judge of middle tennessee

Judicial nominee's ties, qualifications criticized

WASHINGTON — Gustavus "Gus" Puryear IV is the top attorney for Corrections Corporation of America, the Nashville-based private prison giant.

He graduated with honors from law school, is a deacon in his church and serves on the boards of numerous community organizations.

Now President Bush has nominated him to be a federal judge for the Middle District of Tennessee.

But Puryear has never been a judge, has little trial experience, and works for and holds stock in a company enmeshed with the federal government through campaign donations, lobbying and huge contracts.

1. There is no requirement that nominee for the Federal Bench
have been a judge in the past. FDR appointed William O Douglas to the Supreme Court from the Securities and Exchange Commission.

2. Agreed
There is no prerequist for a new federal judge to have ever been a judge ... this is the starting point for many judges.

This does raise two questions. First, why are we allowing any new judicial nominations. If you look back, Clinton did not get any of his judicial nominations out of the Senate in his final year. Second, why would this guy want to move from his high salary job to the modest federal payroll for a judge. I think he has an agenda he hopes to push, likely in creating the need for new prisons to keep business good for his family. There may be a significant conflict on interest in this nomination.

9. Or maybe he sees that in the next administration
being associated with prison industries may not be such a lucrative occupation.

8. Didnt say I was fine with the man as a nominee
merely pointed out that there is not requirement for a federal judge to have been a judge of any shape fashion for form.

10. sorry, you are correct about judges....
the conflict of interest is terribly disturbing....i guess CCA's lobbying money paid off in spades.

~snip~
Puryear is a registered lobbyist for CCA and the company spent more than $3 million in 2007 lobbying the federal government, according to lobbying reports. It has received nearly $1.2 billion in federal contracts since 2004, according to a database of federal contracts compiled by the Office of Management and Budget.

4. Call me crazy, but I don't think a man with ties to
a private prison company should be a judge. That seems like a conflict of interest.

6. No hearing, no recommendation
It's easy, and the Republicans provided the template. Just don't schedule a hearing on this guy's nomination and it goes away. Quick, easy, painless, and really plays to a Democratic strength wherein not doing a goddam thing amounts to being the right thing to do. For once.
