Scalia’s Siren Song
In his dissent in Boumediene, Justice Scalia pulls an old trick from the interventionist hat — that Americans will be safer if they surrender their fundamental rights and liberties to the government. What he’s saying is that Court’s holding recognizing habeas corpus rights to Guantanamo prisoners is going to result in terrorists being set free, who will then return to “the battlefield” to kill Americans.

Scalia’s argument is the siren song of statists, one that has been used by tyrants throughout history to seduce people into surrendering their rights and freedoms for the pretense of safety. As the German people discovered after the German parliament “temporarily” suspended civil liberties after the terrorist attack on the German Reichstag, people who fall for that trick inevitably lose both their freedom and their safety.

6. Actually, that's not the case
The younger justices on the SCOTUS are the conservative ones. The liberals are getting pretty old, and they are the ones most likely to retire first. So Obama will just be replacing old liberals with new liberals. Justice Stevens is in his late 80's, and Ginsberg is in her 70's. Not sure how old Breyer and Souter are. But I believe Roberts and Alito are only in their 50's. And Thomas looks about 60, although I'm unsure of his age.

9. That's true, but I've read a lot of articles about Scalia saying he was ready
to retire. I think he's still very disappointed that he didn't get the nod for Chief Justice. The articles talked about things like him being tired, wanting to do something lese with his life, and make more money. Something about kids going to college. I wouldn't be too surprised if he gets really outnumbered on the court that he would retire because he would view that as a demotion.

The Constitution does not provide that we can override it due to being :scared:

And he is on the highest court in the land, and uses emotion rather than the law. It's disgusting.

16. Scalia's echo Thomas is an RV'er, one of those big land dinosaurs
and he was bitching about a year ago that he doesn't make enough money as a SC toady. I wonder how he feels now that his buddy * has more than doubled gas prices.
